The incident was captured on video and a copy has been requested.  It was later found that the defendant already has two prior convictions for shoplifting within the past seven years.  In accordance with WVC 61-3A-3© if a defendant is convicted of this offense, the conviction would be a felony since it is the third conviction of shoplifting, regardless of the value of the merchandise.
•      Jessica Nicol Poe of Hambleton, was charged with two counts Child Neglect and two charges of Child Restraint. She also received two additional citations, for Driving without a Driver’s Licenses and Driving Left of Center.   According to the criminal complaint Poe was traveling north on WV72 and was observed by officers to be driving recklessly.  She was driving across the center line numerous times and when stopped by officers and asked if she had a driver’s license, she stated no. When asked if she was anyway impaired, she again stated no. The complaint also states that the two children, ages four and two, in the back seat, were not in any type of child restraints/car seats.  Sheriff B.K. Wilfong contacted Robert Poe, who arrived on scene to take the children.  Officer in charge of the case is Chief Deputy E.C. Surguy.
