Tucker County Grand Jury Hands Down Four Indictments
The Tucker County Grand Jury met of Tuesday, June 2 and handed down four separate indictments.
Philip A. Phillips, Sr, of Davis, was originally indicted in February, but those charges were dismissed in March because of incorrect information in the original indictment. Those charges could not be brought up again because they were dismissed without prejudice.
On Tuesday, Phillips was charged with three counts of second degree sexual assault, one count of first degree sexual abuse, six counts sexual abuse by parent or guardian and two counts third degree abuse.
James Waybright, of Parsons, was indicted on one count of first degree sexual assault. Waybright allegedly had intercourse with the victim on July 4, 2013 after she told him she did not want to have sex with him.
Charles W. Miller, Jr., of Thomas, was indicted on three counts of sexual assault in the thrird degree, three counts of abuse of an incapicated person and three counts of sexual abuse by parent or guardian.
George Heihl was indicted for reporting a false claim. He is currently house in the Tygart Valley Regional Jail but the Defendant and State agree that Keihl should undergo an independent psychiatric evaluation to see if he is a likely candidate for probation.
All defendants are presumed innocent until proven guilty in a court of law.
