The following citations have been recorded in the Tucker County Magistrate office:
- Travis J. Moss, Glenville, was cited for speeding (86-45) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $60 and court cost of $165.25.
- Esteban Bernal, New Carrollton, Md. was cited for speeding (59-45) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Christopher M. Smith, Shanks, was cited for driving suspended; miscellaneous by TFC J.J. Schmidle. He pled no contest and was assessed fines of $100 and court cost of $165.25.
- Gregory S. Kisamore, Hambleton, was cited for no seatbelt by Sgt. C.D. Siler. He pled guilty and was assessed fines of $25.
- Stevin C. Teets, Stafford, Va. was cited for speeding (60-45) by Cpl. J.E. Kopec. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Phillip R. Dent, Parsons, was cited for no seatbelt by Sgt. C.D. Siler. He pled no contest and was assessed fines of $25.
- Rodney A. Nelson, Parsons was cited for no seatbelt by Sgt. C.D. Siler. He pled no contest and was assessed fines of $25.
- Jimmy B. Smith Jr., Terra Alta, was cited for no seatbelt by Sgt. C.D. Siler. He pled no contest and was assessed fines of $25.
- Charles D. Simmons, Parsons, was cited for no seatbelt by Sgt. C.D. Siler. He pled no contest and was assessed fines of $25.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Danny Eugene Carr, Parsons, was charged with domestic battery, four counts assault on officer and two counts battery on officer. The criminal complaint states that on Thursday, May 5 at approximately 8:16 p.m. Deputy B.T. Zirk and Duputy C.A. Teter, of the Tucker County Sheriff’s Department, were dispatched to 2272 Mackeyville Road, in Hambleton, for a domestic alteration. When the officers arrived at the residence, they made contact with the defendant, who appeared to be intoxicated, aggressive and angry. Both officers allegedly smelled what appeared to be an alcoholic beverage on his breath. Both officers allegedly attempted to talk to Carr when he started cursing and yelling and allegedly stated “I am going to kill you” and “I am going to kick your a**”. At this point the officers attempted to calm the defendant. Carr allegedly pulled away from the officers in an aggressive manner and attempted to fight with them. He shoved and attempted to pull away from the officers. Zirk and Teter attempted to gain control of the defendant and place him under arrest. The defendant and the officers fell to the ground and Carr received a scratch on his forehead. The step-father (Winfred Shahan) stated to Teter that, prior to the officer’s arrival, there was a verbal altercation between himself and Carr and the defendant punched Shahan in the stomach with his fist causing him pain. The defendant was placed under arrest and transported to the Tygart Valley Regional Jail to await arraignment.
- Ronald Gene Swiger, Elkins, was charged with two counts of permitting unauthorized person to drive. The complaint states that on Nov. 12, 2015, the defendant permitted Jeffrey Boyles to operate a 1999 Mazda four door vehicle on US219 while his privileges to operate a motor vehicle was suspended. He posted a $500 PR bond.
- Michael Kevin Harris, Belington, was charged with driving revoked for DUI. The complaint states that on Saturday, April 30 Trooper First Class J.J. Schmidle, of the Parsons Detachment of the West Virginia State Police, was on road patrol on US219 when he observed a white Ford Escape traveling above the posted speed limit. He activated his RADAR and confirmed the excess speed. He executed a traffic stop and identified the defendant by his WV driver’s license. Schmidle conducted a status check on the license and was advised that his privilege to operate a motor vehicle had been revoked for an active DUI conviction. Schmidle was also advised that the defendant also had an active warrant from Winchester, Va. with extradition for felony shoplifting. A $5,000 cash bond was not posted.
- Jason W. Nestor. Kingwood, was charged with hunting without permission on Nov. 27, 2015 by Cpl. T.L. Fluharty He pled not guilty on May 2.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- Garten verses Hubbard: The court found in favor of Tucker Garten against John Hubbard for the amount of $600 plus $95 court cost. This case was ordered and adjudged on May 2 by Magistrate Riley H. Barb.
- O’Connor verses Shipley: The court found in favor of Craig E. O’Connor against Anthony Wiseman and Sarah Shipley in the amount of $1,100 plus $110 court cost. This case was ordered and adjudged on May 2 by Magistrate Riley H. Barb.
- State of West Virginia verses Seth M. Rosenau: He received judgment of guilty-plea agreement for one count operation of vehicle without evidence of registration which occurred on Sept. 8, 2015. He was assessed fines of $4.75 and court cost of $165.25. He also received a judgment of dismissed-plea agreement for one count registration card to be signed, carried and exhibited on demand for the above date. These cases were ordered and adjudged on May 3 by Magistrate William M. Miller.
