Elke B. Simpson, Hambleton, was cited for speeding (59-45) by Sgt. C.D. Siler. Pled no contest and was assessed fines of $4.75 and court cost of $165.25.
Emily Roberts Whitaker, Hendricks, was cited for cell phone use second offense by Sgt. C.D. Siler. She pled no contest and was assessed fines of $200.
Sandra D. Poling, Hendricks, was cited for no proof of insurance by TFC J.J. Schmidle. The charge was dismissed with proof shown.
Stephen R. Fisher, Key Largo, Fla. was cited for speeding (59-45) by Sgt. C.D. Siler. He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
Billy R. Rohrbaugh, Cabins, was cited for speeding (59-45) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
David L. Gill, Fairmont, was cited for speeding (54-45) and driving suspended by Deputy C.R. Donelson. He pled no contest to both charges and was assessed fines of $9.50 and court cost of $330.50.

The following criminal complaints have been filed in the Tucker County Magistrate Court:
James Dixson Wilson, Dry Fork, was charged with one count Second Degree Sexual Assault and one count Sexual abuse by parent or guardian. According to the criminal complaint, on or about May 19 Chief Deputy E.C. Surguy received a referral from the Department of Health and Human Resources regarding a possible sexual assault. Surguy was advised that CPS made contact with the victim and family and set up a forensic interview with the Children’s Advocacy Center. During the interview, the victim, a minor under the age of 16, disclosed sexual assault which first took place in Tucker County, July 26, 2008, during a family reunion. The victim stated that Wilson allegedly took her to a barn on the family property and allegedly threatened the life of the victim, family and family pet, if she would not engage in sexual intercourse. The victim did not consent to any and all sexual contact with the defendant. He is being housed in the Tygart Valley Regional Jail under a $50,000 cash only bond and further charges are pending.
James Dixson Wilson, Dry Fork, was charged with 552 counts Second Degree Sexual Assault and 552 counts Sexual abuse by parent or guardian. The criminal complaint states that on or about May 19, Chief Deputy E.C. Surguy received a referral from the Department of Health and Human Resources regarding a possible sexual assault. Assaults then allegedly began taking place during the time of the reunion but at the victim’s residence on the dates of July 28, 2012, July 28, 2012, July 27, 2013 and July 26, 2014. On or about May 15, 2015, the defendant moved in with the victim and family and allegedly began assaulting the victim between two and four times daily, involving oral, anal and vaginal intercourse. The defendant is the great uncle to the victim, and has acted in the place of a parent while the parents were not present with the victim. The victim moved out of the residence on or about Oct. 15, 2015, at which time the defendant no longer had access to the victim, and the assaults ended. The victim did not consent to any and all sexual contact with the defendant. The defendant is being housed in the Tygart Valley Regional Jail under an $828,000 cash only bond.
Christine Snyder, Hambleton, was charged with Truancy. The complaint states that Snyder did fail to cause a female minor to regularly attend TVEMS. Student has accumulated 21 full un-excused days. Unexcused absences extended from Oct 19, 2015 through May 20, 2016.
Luke Alan Hemple, Davis, according to the complaint, on Sunday, May 29 Deputy B.T. Zirk was dispatched by Tucker County Comunications to the Thomas area for a juvenile currently residing at the Kenneth “Honey” Rubenstein Juvenile Center who had escaped. Deputies Zirk and C.R. Donelson, Cpl. D.W. Burge and Officer Hartwig had responded to the area to attempt to locate the escapee (Luke Alan Hemple). The father of the escapee (John Hemple) along with the escapees girlfriend Tori Knox, came to visit him and take him out to lunch on an off campus visit. After lunch, Hemple and Knox ran from the father in an attempt to escape custody. The father stated that he made contact with Knox’s mother, and she advised that her daughter had called her and tried to get her to come pick them up and the mother refused. The father then returned to the Juvenile Center and reported the situation to the staff. The defendant and Knox were located together near Hillside Drive in Thomas by Officer Hartwig. The defendant was transported back to the Juvenile Center and was then transported, along with Knox to the Parsons Detachment of the West Virginia State Police for processing by Deputy Zirk.

David Matthew Clark, Morgantown, was charged with Domestic Battery. The criminal complaint states that on Saturday, June 4 Cpl. D.W. Burge, of the West Virginia State Police, was assisting Deputy B.T. Zirk, of the Tucker County Sheriff’s Department, with a complaint of a person brandishing an assault rifle from a vehicle. Burge and Zirk transported Mary Violet Losi and David Matthew Clark to the WVSP Parsons Detachment for processing. At approximately 11:50p.m. Burge observed Losi with dark blue bruises under the eyes. He asked Losi how she got the bruises on her face, and she advised that her boyfriend, Clark, had allegedly been beating on her. She advised that that the defendant had been abusive since she met him a year ago, and that the abuse got worse in October of 2015. She advised that the defendant had allegedly started beating on her with his fist one week ago, and continuously beat her in the face, arms and hit her in the ribs as recent as that day prior to this arrest. She advised that he allegedly has mental issues and believes he is God, and that Clark was dangerous and has threatened to kill her on several occasions. She advised that Clark has been declared mentally disabled and receives a check for mental disability. She also advised that he has been getting more unstable and was waving a gun around at other motorists that day and allegedly threatened to kill her. She said she was in fear for h er safety, and wanted help getting away from the defendant. Burge and Federal Wildlife Officer, B. Hartwig, interviewed Losi and obtained a hand written statement. Burge then obtained digital photos of Losi’s injuries. She advised that Clark had punched her in the ribs while she was driving in Tucker County, and the bruises on her face were created in Mount Morris, Pa. Clark is under a $2,600 cash only bond and is in the Tygart Valley Regional Jail.
David Matthew Clark, Morgantown, was charged with Disorderly Conduct; Unlawful methods of hunting and other unlawful acts; Possession of marijuana; Driving suspended; Conspiracy to violate chapter 20 and Persons prohibited from possession of weapon. The complaint states that on Saturday, June 4 at approximately 7:14 p.m. officers were dispatched by Tucker County Communications to the Parsons area for a reckless driver complaint of a green Ford van. The officers were advised that an unknown caller witnessed a subject in a green van with an assault rifle. Deputy B.T. Zirk traveled to the Parsons area and located the vehicle at the Parsons Sheetz. Upon arrival, Zirk observed the driver and passenger sitting on the walkway. The driver was discovered to be David Matthew Clark and the passenger was Mary Violet Losi. Cpl. D.W. Burge traveled to the site and was advised by Losi that her vehicle had an AR-15 rifle inside. Burge asked Losi for consent to search the vehicle utilizing WVSP for #81 and she agreed and signed said form. Officer B. Hartwig along with Sgt. Gidley arrived on scene shortly after. Hartwig and Burge searched the vehicle and discovered said AR-15 and multiple other concealed weapons inside the vehicle within reach of both occupants. Zirk had patted down both defendants and discovered multiple knives on both. Zirk also discovered what appeared to be a marijuana smoking device on Clark. Both subjects had stated the Clark was operating the vehicle upon arrival at Sheetz. Both were placed under arrest. Upon being arrested, Losi stated that she allegedly had marijuana inside her bra belonging to Clark. Sheriff B.K. Wilfong and Ms. Wilfong were on scene and Ms. Wilfong retrieved a green leafy substance appearing to be marijuana contained inside a small plastic bag. Both were transported to the Parsons Detachment of the West Virginia State Police for processing. During this time Clark persistently used profane language and continued after officers advised him to stop. Losi then allegedly advised Burge that Clark did have an assault rifle waving it around at other motorists. Losi advised that she asked Clark to stop several times. The two were then transported to Tygart Valley regional Jail. Clark is under a $1,800 cash only bond.

State of West Virginia verses Mindy Durham, Parsons, received judgment of guilty verdict for one count Truancy. She was assessed fines of $215.25.
Shiflett verses Summerfield: The court found in favor of Edward S. Shiflett against Anthony Summerfield in the amount of $624.04 plus $80 court cost. This case was ordered and adjudged on June 1 by Magistrate William M. Miller.
Pennington verses Sines: The court found in favor of Shanna Pennington against Brittany A. Sines on the amount of $475 plus $75 court cost. This case was ordered and adjudged on June 1 by Magistrate William M. Miller.
St. George Medical Clinic verses Mullenax: The court found in favor of St. George Medical Clinic against Sondra Mullenax in the amount of $179 plus $75 court cost.
