The following criminal complaints have been filed in the Tucker County Magistrate Court:
Billy Joe Heckler, Hambleton, was charged with defeating drug screening test. The complaint states that on Wednesday, Aug. 31 Deputy C.R. Donelson was contacted by Tucker County Community Corrections Officer, Dustin Luzier, for a client, Billy Joe Heckler, who attempted to defeat a irunalysis test. Luzier stated that while observing Heckler he noticed he was allegedly fumbling with something and asked him to stop. Luzier stated that he asked what Heckler had in his pants and he pulled out a bottle and admitted to trying to use the urine in the bottle to pass the test because he had allegedly smoked some marijuana, snorted a hydrocodone and smoked meth approximately a week prior. He is under a cash bond of $1,000 that was not entered.
Billy Joe Heckler, Hambleton, was charged with driving revoked for DUI. According to the complaint, on Wednesday, Aug. 24 at approximately 12:20 a.m. Deputy C.R. Donelson was patrolling along Goff Cemetery Road when he observed a gray pickup traveling north. Donelson identified the driver, Heckler, by facial recognition and initiated a traffic stop for driving revoked DUI on Mackeyville Road near the intersection of Goff Cemetery Road. After a DMV check of Heckler’s license status, it was confirmed his license status was revoked for DUI with an effective date of May 15. He is under a $1,000 cash bond that was not entered.
Jamie Lee Huffman, Parsons, was charged with making issuing worthless checks. The complaint states that a check for $330 was written for July rent on an apartment in Pine View Apartments. The defendant is under a $530.25 cash bond that was not entered.
Shanna Marie Pennington, Thomas, was charged with fraudulent schemes. The complaint states that on Thursday, July 9 Robin Lynn Darlington arrived at the Parsons State Police Detachment to file a report in regards to the crime of fraudulent schemes. Cpl. J.E. Kopec obtained a written statement summarizing that on Saturday, April 2 the suspect, Shanna Marie Pennington, was employed at her restaurant. Darlington stated that during Pennington’s shift she believes she stole money from the business. Darlington explains that this occurred through a fraudulent scheme of discarding register receipts, guest tickets and hitting the coupon button on the register when breaking change for customers then allegedly pocketing the money for the food and service which the customer paid for. Pennington was asked to come in and talk about the drawer being short and she would not come to the business and did not return to work. Kopec called Pennington and arranged an interview with her and she never arrived. He called her and was informed that she had retained council and to direct further questions to him. She is under a PR bond of $500 that was not entered and a court hearing is scheduled for Nov. 10 at 10 a.m. before Magistrate Riley H. Barb.

State of West Virginia verses Phillip Grant Boyles: he received judgment of Dismissed by Mag-State-No Fee for one count open dumps; one count driving while license suspended or revoked and one count mandatory disposal which occurred on Aug. 15, 2015. Requirements of agreement fulfilled. This case was ordered and adjudged on Aug. 30 before Magistrate William M. Miller.
State of West Virginia verses Jarrod D. Whitehair: He received judgment of Dismissed by Mag-State-No Fee for two counts obscene, anonymous, harassing, threatening communication by electronic device which occurred on Dec. 19, 2015. The case of dismissal is due to victim not cooperating. This case was heard on Aug. 30 by Magistrate William M. Miller.
State of West Virginia verses Sara E. Davis: She received judgment of Dismissed by Mag-State-No Fee for one count truancy. This case was transferred to Circuit Court.
State of West Virginia verses William C. Armstrong Jr.: He received judgment of Dismissed by Mag-State-No Fee for one count domestic battery which occurred on March 16. The victim is not cooperating. This case was heard on Aug. 30 by Magistrate William M. Miller.
Jones verses Long: The court found in favor of Melissa A. Jones against Chrissy and Richard Long in the amount of $500 plus $105 court costs. Respondent must vacate property by Sept. 5. This case was heard on Aug. 30 by Magistrate William M. Miller.
State of West Virginia verses Heather Nicole Watson: She received judgment of guilty plea-agreement for one count shoplifting second offense which occurred on April 17. She was assessed fines of $100, $175.25 and restitution of $50. This case was heard on Aug. 30 by Magistrate Riley H. Barb.
State of West Virginia verses Peggy Sue Heckler: She received judgment of guilty plea-agreement for one count petit larceny which occurred on July 24. She was assessed cost and fees of $165.25 plus restitution of $74.01; suspended jail sentence of one year with credit for time served on 12 days. She must report to Tucker County Community Corrections or finish theft awareness class. This case was heard on Aug. 30 by Magistrate William M. Miller.
