The following citations have been recorded in the Tucker County Magistrate office:
- Cody W. Heckler, Hambleton, was cited for expired registration by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Taylor G. Gardner, Davis, was cited for failure to maintain control and no proof of insurance by Deputy B.T. Zirk. He pled no contest to first charge and was assessed fines of $4.75 and court cost of $165.25. The second charge was dismissed with proof shown.
- Gillian T. Barton-Helmick, Horner, was cited for speeding and driving suspended by Sgt. C.D. Siler. She pled no contest to both charges and was assessed fines of $104.75 and court cost of $330.50.
- Auston J. Edwards, Martinsburg, was cited for driving with no operators and no insurance by Cpl. D.W. Burge. He pled no contest to the first charge and was assessed fines of $4.75 and court cost of $165.25. The second charge was dismissed with proof shown.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Charles Lee Wolfe, Oakland, Md. has been charged with felony counts of strangulation, burglary and kidnapping. The complaint states that on Monday, April 10, at approximately 6:45 p.m. Cpl. D.W. Burge, TFC J.J. Schmidle, of the West Virginia State Police, and Duputy C.R. Donelson, of the Tucker County Sheriff’s Department, were notified of an alleged kidnapping that occurred in Davis. The officers received information that a female was abducted by her boyfriend Charles L. Wolfe from her parent’s residence. While in route, the officers received information that the defendant was heading towards Bayard in Grant County. The officers were further advised that the victim was actively attempting to flee from the defendant and was possibly along WV90 hiding in the woods between Thomas and Bayard. All this information was passed to Grant County 911, who dispatched TFC N.E. Higginbotham (WVSP) to respond. Schmidle and Donelson were the first to arrive in Bayard and began looking for the victim and the defendant. Burge arrived shortly to assist and Garrett County, Md. was also advised due to Wolfe having ties to Maryland. A local resident flagged down Burge and advised of a possible location of the Victim and defendant. Schmidle and Donelson spotted Wolfe, who allegedly appeared to be pulling the victim along the river’s edge. They began a foot pursuit and Burge used his vehicle to cut off the defendant’s escape route. He was taken into custody without incident.
A statement from the victim said that she was at her parent’s residence in Davis when her boyfriend (Wolfe) text saying he was coming to pick her up. She advised she locked the house door and then locked herself into a bedroom. She said she was afraid of the defendant because he had allegedly been abusing her for about eight months. She said he would tell her he was allegedly going to kill her and her family. She explained, today he broke into the house and bedroom and forcibly removed her from the residence. She said once they were outside in the alley Wolfe allegedly put his hands around her neck and began choking her. She thought he was going to kill her. She stated she got into a car and was driven to Bayard, and advised she attempted to escape from Wolfe several times, But he would catch her and throw her down. They ended up behind the sewage plant in Bayard where he allegedly got her down and began choking her again. He told her he was going to kill her by allegedly bashing her head on a rock and then putting her body in the river. He grabbed her arm and headed toward the river, and that was when she heard yelling behind her and saw the officers running toward her.
Wolfe was placed in custody and is being charged for kidnapping, strangulation and burglary in Tucker County and he is being charged with attempted murder, strangulation and kidnapping in Grant County. Higginbotham transported Wolfe to the Moorefield Detachment for processing and then to Potomac Highlands Regional Jail to await arraignment. His bond was set at $150,000 cash only and a preliminary hearing is scheduled for April 19 at 10 a.m. - Tracy Herz, Davis, was charged with truancy, failure to cause a juvenile to attend Davis Thomas Elementary Middle School. The juvenile has accumulated 15 full unexcused days from August 2016 through March 2017.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- City of Parsons verses Jeremy D. Cussins: The court found in favor of the City of Parsons in the amount of $349.35 plus $75 court cost on April 10.
- City of Parsons verses Susan E. Close: The court found in favor of the City of Parsons in the amount of $167.31 plus $75 court cost on April 10.
- State of West Virginia verses Terry L. Webb II, Salem, received judgment of a guilty plea for one count driving impaired. He received credit for time served of 24 hours, a fine of $100 and cost and fees of $240.25 on April 11.
- State of West Virginia verses Justin K. Knicely, Buckhannon, received judgment of a no contest plea for one count no vehicle insurance. He was assessed fines of $200 and court cost of $165.25. Motion by the State to dismiss one count of driving while license suspended or revoked was granted.
- Parsons Shop N Save verses Robert C. Filer: received judgment of a no contest plea for one count making, issuing worthless checks. He was assessed fines of $1, court cost of $190.25 and restitution of $38.24 on April 11.
All of the above cases were heard by Magistrate Riley H. Barb.
