Magistrate News – June 14, 2014

The following citations have been recorded in the Tucker County Magistrate office:

  • Christopher  S. Cormier,  Beverly, was cited for speeding (59-55) by TFC J.J. Schmidle.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
  • James  W. Mollard, Davis,  was cited for no insurance by Cpl. D.W. Burge.  The charge was dismissed with proof shown.
  • Christine  M. Krompecher,  Charleston, was cited for expired MVI and no insurance by Cpl. D.W. Burge.  She was  assessed fines of $4.75 and court cost of $165.25.  The second charge was dismissed with proof shown.
  • Charles  D.  Simmons, Parsons, was cited for no seatbelt by Sgt. C.D. Siler.  He pled guilty and was assessed fines of $25.
  • Louise  A. Skonier,  Elkins, was cited for speeding (69-55) by Sgt. C.D. Siler.  She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
  • Edward  D. Wisnewski,  Maysville, was cited for cell phone use by Sgt. C.D. Siler.  He pled no contest and was assessed fines of $100.
  • Muhammad S. Khan, Springfield, Va. was cited for speeding (61-45) by Sgt. C.D. Siler.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
  • Tina  M. Carr,  Parsons, was cited for no insurance by Cpl. D.W. Burge.  The charge was dismissed with proof shown.
  • Randall   O. Tuttle, Parsons, was cited for speeding (69-55) by Sgt. C.D. Siler.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.

The following criminal complaints have been filed in the Tucker County Magistrate Court:

  • Daniel Leon Sherman, Montrose, was charged with domestic battery.  The complaint states that on Friday, June 2 at approximately 2:35 p.m. James Monroe Sherman called Tucker County 911 and reported that his brother, Daniel Leon Sherman, had allegedly struck him with a narrow oak board.  This occurred at the Daniel Sherman residence as a result of an argument.  F/Sgt. K.L. Keplinger, of the West Virginia State Police, observed a red welt across the victim’s upper abdomen.  Keplinger obtained a statement from the victim.  James Sherman obtained a protective order against the defendant.  At approximately 6:30 p.m. Keplinger located the defendant and he was arrested for domestic battery and the protective order was served at this time.  He posted a $500 PR bond.
  • Heather Nicole Watson, Parsons, was charged with battery.  According to the complaint, on Monday, May 29 the defendant traveled to the Chop Shop Salon.  The defendant entered the salon and after a short altercation, a worker at the salon advised the defendant to exit the premises.  The defendant allegedly attempted to throw hot coffee on the worker and she forced her hand away.  The worker reportedly forced the defendant outside while she struck the worker with a closed fist in the chest and scratched her arm.  The defendant picked up a rock in an attempt to hit the worker and she allegedly punched the defendant.  She was again advised to leave the premises and reportedly refused to leave.  Only when police were called did she drive away.  Small scratches were observed on the arm of the worker.  She posted a $700 PR bond and a court hearing is scheduled for August 17 at 10:30 a.m. before Magistrate Riley H. Barb.
  • William Jack Plum, Parsons, was charged with DUI.  The complaint states that on Friday, May 26 Cpl. D.W. Burge was contacted by Elkins Communications via telephone and advised of a single vehicle accident on US219 near Luke Mullenax Road.  Burge traveled to the accident scene and observed a gray Subaru lying on its roof in the ditch.  Burge observed a man walking towards the Cruiser.  He observed Plum had a cut on his head and cuts on his legs.  Burge asked him who was driving and Plum advised   “I was driving.”  Burge observed the odor of alcohol on his breath and that he had red, bloodshot, glassy eyes and slurred speech. Burge asked Plum if he had been drinking and he allegedly advised no.  Plum failed the PBT test and other field sobriety tests.  Plum ten advised  “I think I am going to the hospital, I am hurting.”  Plum left the accident scene with Tucker County EMS.  On Tuesday, May 30 Burge served a search warrant to Davis Medical Center for the medical records of Plum for the accident.  He obtained said  records which showed the blood tests ran on Plum had a .116 BAC level.  He posted a $500 PR bond
