The following citations have been recorded in the Tucker County Magistrate Office:
- Billy W. Roy, Parsons, was cited for no seatbelt and no proof of insurance by Sgt. C.D. Siler. He pled no contest to the first charge and was assessed fines of $25. The second charge was dismissed with proof shown.
- Katelynn I. Bowers, Parsons, was cited for speeding (45-35) and no insurance by Cpl. D.W. Burge. She pled no contest to the first charge and was assessed fines of $4.75 and court cost of $165.25. The second charge was dismissed with proof shown.
- John M. Brinjac, Wormleyburg, Pa. was charged with speeding (44-35) by Deputy C.R. Donelson. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Laura E. Remes, Washington, DC was cited for speeding (69-65) by TFC J.J. Schmidle. She pled no contest and was assessed fines of $4.l75 and court cost of $165.25.
- Michael A. Witemore, Hambleton, was cited for no proof of insurance by Deputy B.T. Zirk. The charge was dismissed with proof shown.
- Gladys Jane Pifer, Parsons, was cited for overtaking a school bus by Cpl. D.W. Burge. She pled not guilty on Aug. 29 and a court hearing is scheduled for Oct. 23 before Magistrate Riley H. Barb.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Garrett Alexander DeBerry, Davis, was charged with one felony count of Escape, one count of B&E to Auto and one count Destruction of Property. According to the complaint, on Sunday, July 30 Garrett Alexander DeBerry and Travis Roy Jarrell escaped from the Kenneth “Honey” Rubenstein Center. They walked to the nearby Youth Science Center, a fenced and gated facility where they entered the facility fence. They broke a driver’s side door lock on a Ford truck. They allegedly entered two other vehicles, breaking windows, door locks and steering columns, also allegedly removing items from both vehicles. They exited the facility and entered a nearby wooded area. They were apprehended by staff from the Rubenstein Center and on their possession were multiple pieces of property from the Youth Science Center vehicles. The director of the Youth Science Center was contacted and advised that these vehicles had no prior damage and security video showed two male subjects entering the facility as well as being in the area of the damaged vehicles. DeBerry in confined for the crime of Burglary, Jarrell is confined for Probation Violation. A $5,000 cash only bond was not posted.
- Travis Roy Jarrell, Davis, was charged with one count of Escape, one count of B&E to Auto and one count Destruction of Property. - Heather Nicole Watson, Parsons, was charged with DUI Second offense; Driving Revoked for DUI; Driving Suspended Third Offense; Possession of Marijuana and Obstructing/Resisting an Officer. According to the complaint, on Sunday, Aug. 27 Sgt. C.D. Siler, of the West Virginia State Police, received a complaint of suspicious activity at the storage buildings located near the intersection of Holly Meadows Road and WV72. Upon his arrival he observed a vehicle with two females inside. Upon approaching the vehicle, Siler smelled marijuana smoke coming from inside of the vehicle. The passenger was identified as Felicia Ann Coleman and the driver was the defendant, Heather Nicole Watson. The two were separated and Coleman allegedly confessed that she had smoked marijuana with the defendant. She also stated that they had taken a short drive down the road and back and were sitting there talking when Siler pulled in. The defendant was having a hard time talking and motor skills were delayed. She lied at first and then retrieved a smoking device from under the dash. She allegedly told him they had smoked all the marijuana and gave him permission to look in the car if he wanted. He found a small red plastic container that contained a green leafy substance that tested positive to be marijuana. He also located a plastic pill crusher under the driver’s seat. He located a prescription bottle for a generic for Suboxton with the name of William Demoss. Deputy B.T. Zirk was speaking with the defendant and found six cut off straws that had been used to snort a white powder in the defendant’s purse as well as a prescription of Suboxton. The defendant allegedly stated to Siler that she had only driven from Moss Lane to the storage buildings. Also while dealing with the defendant she was told to stay near the rear of the vehicle and three times she walked toward Siler’s vehicle and was told to get back. Twice she was told to stay out of her purse and she did not listen. Coleman allegedly stated that the defendant had told her to meet at the storage buildings to smoke marijuana. She stated that the defendant drove and they had been down by the river smoking and had returned to the buildings where they were found by Siler. The defendant was asked to perform three sobriety tests and she failed two. Upon running the defendant’s license and a criminal check, Siler learned that she had a prior conviction for DUI with minor in vehicle on May 11. He also learned that she had four suspensions for unpaid citations. She had a revocation for DUI with minor in on Dec. 5, 2016. She had a prior conviction for driving suspended third offense from April, 2016. She was placed under arrest and transported to the Parsons Detachment of the West Virginia State Police for processing. While at the detachment, she was read her Miranda warning from the DUI information sheet, which she signed and agreed to answer questions. During this interview the defendant allegedly confessed to driving under the influence of marijuana and Suboxton. She also confessed to smoking marijuana at the time Siler pulled in behind her. She allegedly confessed to driving from Moss Lane to the storage buildings on Holly Meadows Road. She could not tell Siler the correct date or day of week. She posted a property/surety bond of $5,500 and a court hearing is scheduled for Oct. 17 at 10 a.m. before Magistrate William M. Miller.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Jeffrey A. Barb, Parsons, received judgment of no contest plea for one count Violation of Protective Order which occurred on May 16, 2016. He received credit for time served on 60 days. This case was heard on Aug 24 by Lynn A. Nelson.
- State of West Virginia verses Christopher John Allen Petty, Lancaster, Ohio received judgment of guilty-plea agreement for one count Violation of Protective Order; repeat offenses. He was assessed fines of $250, cost and fees of $165.25 and credit for time served of 20 days. This case was heard on Aug. 30 by Magistrate Riley H. Barb.
- State of West Virginia verses Delbert Varner, Parsons, received judgment of guilty verdict for one count indencent exposure which occurred on June 15. He was assessed cost and fees of $178.85, a ten day suspended jail sentence and ten days at Tucker County Community Corrections for counseling as needed. This case was heard on Aug. 22 by Magistrate William M. Miller.
