The following citations have been recorded in the Tucker County Magistrate office:
- Aaron D. Friedman, Elkins, was cited for speeding (39-25) by Deputy B.T. Zirk. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Jillian R. Varnar, Leesburg, Va. was cited for failure to maintain control by F/Sgt. K.L. Keplinger. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Cameron I. Lloyd, Elkins, was cited for no registration and expired MVI by Cpl. J.E. Kopec. He pled no contest to both charges and was assessed fines of $9.50 and court cost of $330.50.
The following criminal complaints have been recorded in the Tucker County Magistrate Court:
- Jason Richard White, Kerens, has been charged with one felony count of Murder in the First Degree. According to the complaint, on Sunday, Sept. 3 at approximately 5:11 a.m. Tucker County 911 received a call in reference to a female that had been shot at 905 Pheasant Run Road. TFC J.J. Schmidle, of the West Virginia State Police, Tucker County EMS and several other law enforcement officers were notified. First on scene was WVSP Cpl. J.E. Kopec who found the victim, later identified as Nakeia Alisa Moore, lying in the residence with a single gunshot wound to her chest. Moore was unable to positively identify her attacker, she was transported by Tucker Co EMS and was later pronounced dead at Davis Medical Center. WVSP F/Sgt. K.L. Keplinger arrived on scene and found a male subject identified as Jason Richard White sitting outside the residence with Kopec. White allegedly advised he had discovered Moore shot in the residence and had run next door to call 911. He allegedly stated that he was not at the residence at the time of the shooting and had not seen anything. He is on home confinement and had a GPS monitoring device attached to his ankle. On Monday, Sept. 4, Keplinger was able to locate a witness that allegedly heard a gunshot in the immediate area of the incident. The witness stated that the gunshot was at approximately 5 a.m. Schmidle was also notified by community corrections that they had received the GPS points from White’s monitoring device and it placed him in the residence at the time of the shooting. On Tuesday, Sept. 5 Troopers at the WVSP Parsons Detachment identified another witness who was allegedly at the scene of the shooting. Troopers and members of the Mountain Region Drug and Violent Crime Task Force interviewed the witness. According to this witness, White and Moore and allegedly been up arguing all night. The witness advised the arguing had started to escalate and the witness left the residence. The witness said the only people in the residence were White and Moore. The witness allegedly stated after walking no more than ten feet from the residence when a gunshot was heard. The witness said White allegedly came out of the residence and said to get help. White was scheduled for a preliminary hearing on Sept. 12 at 10:30 a.m. before Magistrate Riley H. Barb.
- Aaron Chris Paugh, Thomas, was charged with one count Domestic Battery, second offense; one count Interfering with Emergency Communications and one count Destruction of Property. The complaint states that on Tuesday, Sept. 5 at approximately 2:40 a.m. acting Chief Deputy C.R. Donelson, of the Tucker County Sheriff’s Office, was dispatched by Tucker County 911 to 376 Fairfax Ave in Davis for a domestic altercation. Upon arrival, he spoke with the victim, Tracy Mullennex, who said the defendant allegedly hit her multiple times. She allegedly stated that the two were in a verbal altercation when the defendant became irate and attempted to grab her phone whereas she fell on the couch and at that time was allegedly punched in the eye, head and arm. She said she was able to get away from him after she punched him in the nose and she took off running, prior to grabbing her son and leaving the residence located at 382 Grant St. in Thomas. She also stated that she allegedly attempted to call 911 whereas Paugh took her phone and smashed it. Donelson observed Mullennex to have injuries consistent with her statement as well as a broken cell phone. Paugh has a prior conviction for domestic assault on Oct. 13, 2016. A property/surety bond of $3,500 was not entered and a hearing is scheduled for Sept. 26 before Magistrate Riley H. Barb.
- Robert Lee Roy, Hambleton, was charged with one felony count of Strangulation and one count of Domestic Battery. According to the complaint, on Tuesday, Sept. 5 at approximately 2:42 p.m. officers were dispatched by Tucker County 911 to apartment #7 of the Mountain View Apartments in Hambleton for a domestic fight call. Upon arrival, officers met with the victim, Aleah McCrum, who allegedly stated that she and the defendant got into a verbal altercation about him not working. During this argument the defendant cussed her and called her vulgar names. Allegedly he grabbed her by the mouth and slammed her into the wall, hitting the back of her head. He pinched her nose shut and put pressure on her throat which caused her to start to lose consciousness and she could not breathe. She began scratching and clawing at the defendant in an attempt to get free. She finally got free of his grip and “started screaming for help at the top of her lungs.” The defendant allegedly grabbed a pillow and stuck it over her face causing her not to be able to breathe again. She got free again and tried to run upstairs to get away from the defendant, at which point he kicked her in the right leg/hip. She was able to get upstairs and contact her landlord. The officer observed red marks on her face, right leg/hip and neck areas. The defendant allegedly had scratch marks under his left eye, on his left cheek and face. Officers spoke with Amy Owens who stated that she had received text messages from the victim about needing help and contacting 911. A cash bond of $5,500 was not entered and a preliminary hearing was scheduled for Sept. 8 at 10 a.m. before Magistrate William M. Miller.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses William R. Snyder: He received judgment of motion by the Prosecuting Attorney to dismiss- Granted by the Magistrate-No fees charged on the case for one count trespass on property other than structure or conveyance which occurred on May 24. Motion to dismiss by the State was granted. This case was heard on Aug. 31 by Magistrate Riley H. Barb.
- State of West Virginia verses Garrett A. DeBerry: He received judgment of Dismissed for one count entry of building other than dwelling; motion to transfer to Circuit Court. This case was heard on Aug. 31 by Magistrate William M. Miller
- State of West Virginia verses Garrett A. DeBerry: received judgment of preliminary hearing waived for one count escape or attempt to escape from custody of the Director of Juvenile Services which occurred on July 30. This case was bound over to Circuit Court.
- St. George Medical Clinic verses Danielle Carr: She received judgment of Dismiss pursuant to Rule 15(b). This case was heard on Aug. 25 by Magistrate William M. Miller.
- State of West Virginia verses William Scott Nestor: received judgment of Guilty-plea agreement for one count unlawful injury to or destruction of property which occurred on June 28. He was assessed cost and fees of $208.85 and must pay restitution of $783.31. He received credit for time served of two months. He also received judgment of Motion by the Prosecuting Attorney to dismiss-Granted by the Magistrate-No fees charged on the case for one count fleeing from officers and one count obstructing officers. Motion to dismiss per plea agreement was granted. This case was heard on Aug. 31 by Magistrate Riley H. Barb.
- State of West Virginia verses Jeffrey P. Boyles: He received judgment of Guilty-plea agreement for one count Violation of Domestic Violence Order which occurred on July 7. He was assessed cost and fees of $165.25 and a suspended jail sentence of 30 days. He also received judgment of Guilty-plea agreement for one count misdemeanor offenses for Violation of Protective Order, repeat offenses which occurred on June 23. He received a suspended jail sentence of 30 days and Day Reporting Center for 60 days. These cases were heard on Sept. 1 by Magistrate William M. Miller.
