The following citations have been recorded in the Tucker County Magistrate office:

  • William A. Lucas, Mt. Lake Park, Md., was cited for failure to yield by TFC J.J. Schmidle. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
  • Melissa M. Evans, Hambleton, was cited for no seatbelt by Sgt. C.D. Siler.  She pled no contest and was assessed fines of $25.
  • Bradford N. Harvey, Buckhannon, was cited for hunting bear without ADS stamp by Sgt. J.T. Craig.  He was assessed fines of $25 and court cost of $165.25.
  • Derek A. Makin, Windber, Pa. was cited for hunting in closed season and uncased firearm during closed season by SNRPO D.B. McFarlan.  He was assessed fines of $40 and court cost of $330.50.
  • Joseph A. Drescher, Somerset, Pa. was cited for hunting in closed season and uncased firearm during closed season by SNRPO D.B. McFarlan.  He was assessed fines of $40 and court cost of $330.50.
  • Charity L. Taylor, Dailey, was cited for speeding (75-65) by Cpl. D.W. Burge.  She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
  • Linda L. Persutti, Hambleton, was cited for improper registration and no WV MVI by Cpl. D.W. Burge.  Both charges were dismissed with proof shown.
  • Joseph A. Drescher, Somerset, Pa. was cited for kill/take during closed seasosn and replacement fee for killing a doe by SNRPO D.B. McFarlan.  He was assessed fines of $220 and court cost of $165.25.

The following criminal complaint has been filed in the Tucker County Magistrate Court:

  •  Brian Dale Sipe, Belington, was charged with Prohibited person in possession of a firearm. The complaint states that on Monday, Oct. 2 Sr. Trooper C.E. Elliott, of the West Virginia State Police, entered the Parsons Sheetz store and observed the defendant, who began to act suspicious.  The officer knew the defendant from prior dealings.  The officer made contact with the defendant and asked if he had paid for the items he was eating, which he stated that he had brought the items into the store with him.  The officer asked if he had any outstanding warrants to which he replied “no”.

    During the interaction the accused appeared disoriented and to be under to influence of an unknown substance.  Elliott observed an unidentified bulky object under the accused shirt in the front waistband of his pants.

    Based on previous interactions, the accused is known to carry a firearm which is often located in his waistband.  The officer asked the defendant if he was in possession of any firearms and he stated, “I don’t have any guns.”  The officer then lifted the front of the accused shirt and allegedly revealed a stainless steel pistol.  Upon revealing the pistol, the accused fled from the officer on foot.  The officer pursued the accused through the parking lot of Sheetz and Little Andi’s where he continued down Davis Street and onto Poplar.  Do to this being a residential area the officer broke off pursuit and returned to Sheetz.  The officer returned to Sheetz and was informed that the accused had fled with items from the store totaling $3.48.  The officer asked for video of the incident.  A criminal history check of the accused found a prior conviction for prohibited persons in possession of a firearm along with two prior convictions for possession of a controlled substance.  A cash or surety bond of $5,000 was not entered.
