The following citations have been recorded in the Tucker County Magistrate office:
- Toby L. Helmick, Elkins, was cited for expired MVI by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Kathryn R. Howard, Elkins, was cited for no insurance by Cpl. D.W. Burge. The charge was dismissed with proof shown.
- Connor N. Calarco, Fairfax, Va. was cited for speeding (35-25) by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Daniel K. Leach, Elkins, was cited for driving suspended and no MVI by Deputy C.A. Teter. He pled no contest to the first charge and was assessed fines of $100 and court cost of $165.25. The second charge was dismissed with proof shown.

The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Brian Dale Sipe, was charged with Destruction of Property. According to the complaint, on Wednesday, Nov. 29 acting Chief Deputy C.D. Donelson of the Tucker County Sheriff’s Office was notified that a prisoner had allegedly damaged a jail cell, located in the Tucker County Courthouse, by removing paint from the wall with restraints. After speaking with Chief Rowe of the Parsons Police Department, it was learned that the prisoner’s name was Brian Dale Sipe. Donelson observed marks on the cell wall consistent with being willfully damaged. He obtained video surveillance from Tucker County 911 and observed Sipe allegedly removing paint with his restraints. A cash bond of $200 was not entered and a preliminary hearing is scheduled for Jan. 9, 2018 at 10:15 a.m. before Magistrate William M. Miller.
- Kimberly Marie Swecker, Elkins, was charged with Shoplifting Third Offense. The complaint states that on Nov. 16 the defendant was in the Sheetz Store in Parsons with Levi McCauley and she allegedly stole a cigarette lighter valued at $2. A video allegedly shows the defendant removing the lighter from the store without paying for same. A check through Triple I revealed that the defendant had four previous convictions of shoplifting. A cash bond of $5,000 was not entered a PR bond of $5,000 was transferred. She pled not guilty on Nov. 30 and a preliminary hearing was waived. She was indicted to Tucker County Circuit Court. A $10 fee was assessed.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Mark M. Orielly, II, Burlington, received judgment of Motion by the Prosecuting Attorney to dismiss – Granted by the Magistrate – No fees charged on the case for one count operation without cert. inspection or failure to produce certificate and a second charge of Improper use of evidence of registration which occurred on Nov. 12. This case was heard on Dec. 4 by Magistrate William M. Miller.
- State of West Virginia verses Jessica N. Bryan, Harman, received judgment of Preliminary hearing waived for one count Burgulary by entering with or without breaking which occurred on July 28. A $10 fee was assessed and this case was bound over to Tucker Count y Circuit Court. This case was heard on Dec. 6 by Magistrate William M. Miller.
- St. George Medical Clinic verses Lantz, On Dec. 6 the court granted Dismissed Pursuant to Rule 15(a) against Charles Lantz. Service of summons and complaint has not been made upon the defendant. This case was ordered and adjudged on Dec. 6 by Magistrate William M. Miller.
- State of West Virginia verses James P. Michael, Parsons, received judgment of Guilty-Plea agreement for one count Driving vehicle while in an impaired state, but with alcohol concentration of <.15 this occurred on July 1. He was assessed fines of $100 and cost and fees of $240.25. He received credit for time served on one day. This case was heard on Nov. 30 by Magistrate William M. Miller.
- State of West Virginia verses Heather H. Watson, received judgment of Guilty-Plea agreement for one count driving under influence second offense, six months home confinement; judgment of Guilty-Plea agreement for one count driving while license revoked-DUI, six months home confinement; judgment of Dismissed-Plea agreement for one count obstructing officers; judgment of Dismissed-Plea agreement for one count driving while license suspended of revoked and judgment of Dismissed-Plea agreement for one count knowingly or intentionally possessing a controlled substance without a valid prescription. She received a suspended jail sentence of one year, six months home confinement, fines of $100 and cost and fees of $385.50. All charges run concurrent, this case was heard on Nov. 30 by Magistrate William M. Miller.
