The following citations have been recorded in the Tucker County Magistrate office:
- Robert W. Arbogast, Essex, Md. was cited for improper disposal by WVDNR Brian E. Nuzum. He was assessed fines of $20 and court cost of $165.25.
- Scott W. Truman, Sykesville, Md. was cited for expire registration and no insurance by Cpl. D.W. Burge. Both charges were dismissed with proof shown.
- Richard J. Cussins, Thomas, was cited for loaded rifle (muzzleloader) by WVDNR. He was assessed fines of $20 and court cost of $165.25.
- Louis A. Somers, Jr. Berkeley Springs, was cited for no MVI by Cpl. D.W. Burge. He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
- Ebonie T. Hicks, Stafford, Va. was cited for speeding (69-65) by TFC J.J. Schmidle. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Elizabeth J. King, Davis, was cited for no insurance and expired registration by Cpl. D.W. Burge. The first charge was dismissed with proof shown and she pled no contest to the second charge. She was assessed fines of $4.75 and court cost of $165.25.
- James R. Humphrey, Mount Airy, Md. was cited for speeding (74-65) by Cpl. J.E. Kopec. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Thomas R. Wratchford, Parsons, was cited for no insurance by Cpl. D.W. Burge. The charge was dismissed with proof shown.
- Christopher L. Friend, Eglon, was cited for speeding (82-65) by K.L. Keplinger. He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Ronald Dale Poling, Parsons, was charged with Obstructing/Resisting an Officer. According to the complaint, on Sunday, Jan. 14 at approximately 10:47 p.m. Cpl. D.W. Burge of the WVSP and Deputy C.R. Donelson of the Tucker County Sheriff’s Department traveled to the residence of the defendant for a 911 call of a domestic Battery. Upon arrival the officers asked the defendant what was going on at the residence and he advised nothing, just an argument between him and his girlfriend. Burge observed the odor of an alcoholic beverage on the defendant’s breath and Burge asked the girlfriend how much alcohol the defendant had drank today, and she allegedly advised he had had about 30 beers. Burge asked her what had happened and she advised that she had been arguing with the defendant due to him telling her to leave but would not let her get her personal belongings. She advised that Poling allegedly got in her face and she pushed him back. He became very argumentative and jumped up from the couch. Burge told him to stop arguing and he jumped up again and allegedly advised take me to jail. The officers told him to sit back down and he could tell his side in a minute. He became argumentative again and started yelling to take him to jail. Burge arrested Poling for obstructing an officer and transported him to the Parsons Detachment of the West Virginia State Police. Upon arrival he became very loud and argumentative. He was told to sit down and he got up and walked toward Burge. He was told to sit down again and he said no. At this time Burge assisted Poling to the chair again and he jerked away and slid onto the floor. A Bench Trial is scheduled for March 13 at 10 a.m. before Magistrate Riley H. Barb.
- Jonathan Cordaro Kile, Petersburg, was charged with Person Prohibited from Possessing Firearms. According to the complaint, on Thursday, Jan. 11 Sgt. C.D. Siler of the WVSP was at the resicence of Kevin Dillow and Sabrina Leary in Davis assisting the Elkins Parole Office in search of the defendant. There had been information that Dillow had allegedly purchased a 9mm pistol from the defendant. Upon arrival the defendant was located on the fron porch and was taken into custody for a parole violation. Siler spoke with Dillow who stated that he had a 9mm pistol that he had purchased for his girlfriend. He also stated that he had shown it to the defendant who had handled said gun to look at it. He also stated that he did not know the defendant was prohibited from being in possession of a firearm. He went on to state that the defendant allegedly tried to get him to purchase a tactical shotgun for him, but he refused. Dillow showed the firearm in question to Siler. When asked, the defendant allegedly admitted he had handled said firearm. Elkins Parole had found a picture of said firearm on the defendant’s cell phone. The defendant was and is well aware that he is not allowed to be in possession of any firearms. He signed his parole intake packet before going on parole in which stated and explained he was prohibited from handling any firearms. A cash bond of $1,000 was not posted and a court hearing is scheduled for Feb. 28 at 10:30 a.m. before Magistrate William M. Miller.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Jerry L. Burkhammer, Weston, received judgment of Dismissed for one count Harassment and one count Stalking which occurred on March 26, 2017. A motion by the State to dismiss was granted. This case was heard on Jan.17 by Magistrate Riley H. Barb.
- State of West Virginia verses Dustin Bruce Moran, Parsons, received judgment of Probable Cause Found for one count Enticing away; kidnapping or hold hostage any person which occurred on Jan. 2. The case was bound over to the Tucker County Circuit Court. This case was heard on Jan. 16 by Magistrate Riley H. Barb.
