Magistrate News

The following citations have been recorded in the Tucker County Magistrate office:

• Melissa Ann Rubeseh, Parsons, was cited for no proof of insurance by Deputy C.A. Teter.  The charge was dismissed with proof shown.
• Arthur J. Davis, Hambleton, was cited for expired MVI by Cpl. J.E. Kopec. The charge was dismissed with proof shown.
• Kevin C. Gill, Davis, was cited for Expired MVI by K.L. Keplinger.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Andrew J. Kisamore, Lahmansville, was cited for driving suspended (misc) 1^st. by TFC J.J. Schmidle.  He pled no contest and was assessed fines of $100 and court cost of $165.25.
• Eldon R. Plaugher, Parsons, was cited for failure to stop at stop sign and no proof of insurance by TFC J.J. Schmidle.  Both charges were dismissed.
• Matthew P. Smith, Buckhannon, was cited for speeding by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Joseph P. Cannon, Davis, was cited for speeding (55-45) by Cpl. D.W. Burge.  He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
• Courtney B. Weese, Elkins, was cited for speeding (69-55) by Sgt. C.D. Siler.  She pled guilty and was assessed fines of $4.75 and court cost of $165.25.
• Dawn Amelia Crites, Petersburg, was cited for speeding (64-45) by Deputy C.R. Donelson.  She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Edwin F. Evans, Hambleton was cited for no insurance by Cpl. D.W. Burge. The charge was dismissed with proof shown.
• Robert J. Boggs, Elkins, was cited for speeding (68-55) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Loretta J. Dimaio, Thomas was cited for no insurance by Cpl. D.W. Burge. The charge was dismissed with proof shown.
• Jason R. Sines, Davis, was cited for no proof of insurance by Deputy B.T. Zirk.  He pled no contest and was assessed fines of $200 and court cost of $165.25.
• Cortney L. Taylor-Felton, Mill Creek, was cited for driving suspended (misc) by Deputy B.T. Zirk.  She pled guilty and was assessed fines of $100 and court cost of $165.25.

The following criminal complaints have been filed in the Tucker County Magistrate Court:

• Kimberly Marie Swecker, Elkins, was charged with driving suspended for Misc. 3^rd offense.  The complaint states that on Friday, Jan. 26 Cpl. J.E. Kopec was traveling south on Shavers Fork Road when he observed a black SUV parked in the River Bend Church parking lot.  When the driver of the vehicle saw Kopec’s vehicle she drove across Shavers Fork Road to the other side of the parking lot.  Kopec, suspecting this to be suspicious, shined his sopt light and observed the driver to be the defendant.  Knowing the defendant from previous dealings he conducted a traffice stop due to the suspicious nature.  He ran a license check on the defendant and found that her license was suspended for multiple unpaid citations.  He arrested her and transported her to the Parsons Police Detachment for processing and then to the Tygart Valley Regional Jail.  She posted a $500 PR bond and a court hearing is scheduled for March 8 at 10:30 a.m. before Magistrate William M. Miller.
• Marshall Dewaine Parsons, Jr. Hambleton, was charged with misdemeanor offenses for violation of protective order and obstructing officer.  According to the complaint, on Saturday, Jan. 27 Deputy B.T. Zirk was dispatched by Tucker County Communications 911 to 848 Hendricks Hill Road for a 911 hangup call.  Zirk and Chief Deputy C.R. Donelson of the Tucker County Sheriff’a office responded.  While on scene the officers were met by the complainant Morgan Lynn Parsons.  Zirk obtained a hand written statement from her stating she had come home to her residence to get clothes.  She allegedly stated her brother-in-law was with her and he went to check the rooms.  She said she went into the bathroom and when she came out her husband, the defendant, was in the hallway.  She said he allegedly asked her to not do this and to stay one night with him.  She said her brother-in-law allegedly got in between them and she went back to her vehicle.  She said she got her kids out of her brother-in-law’s vehicle and put them in hers. She stated the defendant allegedly came out of the house and to the driver side door.  She laid her phone down beside her and dialed 911.  She further stated that the defendant grabbed the phone and stepped away from the vehicle and she drove off.  A Domestic Violence Protection Order (DVPO) was issued a few hours prior to the incident.  Zirk and Sgt. D.E. Gidley of the Parsons Police Department served the order earlier that day.  She stated to Zirk that her brother-in-law and the defendant had left and possibly went to the brother-in-law’s residence.  The officers went to that residence to attempt to locate the defendant.  While speaking with the home owner, a vehicle operated by Parsons brother-in-law stopped in front of the residence and the defendant was observed in the front seat.  Zirk told the defendant he was under arrest and to step away from the vehicle.  He would not comply and began to argue.  Zikr told him multiple times and he refused to comply.  Zirk and Donelson removed him from the vehicle and placed him in handcuffs.  He was then transported to the Parsons Detachment of  the WVSP for processing and then to the Tygart Valley Regional Jail.  A cash bond of $4,000 was not posted.
• Tiffany Nicole Henline, Elkins, was charged with battery.  The complaint states that on Tuesday, Aug. 15, 2017 acting Chief Deputy C.R. Donelson of the Tucker County Sheriff’s office was dispatched by Tucker County 911 to 353 Moss Lane for a battery complaint.  Upon arrival, Donelson met with the victim, Heather Watson, who stated that the defendant allegedly battered her. She stated that she was talking on her cell phone outside near her residence when a maroon sedan pulled up and stopped near her.  As she walked over to the vehicle she observed the defendant in the back seat and at that point tried to start a conversation with her.  She states that the defendant allegedly then grabbed her right arm pulling her into the car, punched her in the face and then pushed her.  She further states that Henline allegedly got out of the vehicle and pulled her by the hair to the roadside.  Donelson observed bruising and scratches consistent with her statement.  A $500 cash bond was not posted.
• Clinton Dale Streets, Davis, was charged with joy riding and driving suspended 3^rd.  The complaint states that on Friday, Jan. 19 Kathy Hawes let the defendant borrow her vehicle for an allotted time of approximately 20 minutes to pick up a relative of her’s whom he was dating.  The defendant was told numerous times to bring the vehicle right back.  He took the vehicle and did not return within the allotted time.  She waited until 10 p.m. before calling in and reporting the joy riding complaint.  On the evening of Saturday, Jan. 20 he was pulled over in Elkins and the vehicle was impounded for him driving suspended.  He allegedly had not called Hawes to let her know what happened.  Cpl. J.E. Kopec conducted a license check on him and found he had two driving while license suspended convictions on 2014 and 2016.  A cash bond of $1,000 was not posted and a Bench Trial is scheduled for Feb. 15 and 11 a.m. before Magistrate Riley H. Barb.
• Katelyn Nicole Seaman, Elk Garden, was charged with Battery.  According to the complaint, on June 15, 2017 at approximately, 3:30 p.m. Cpl. J.E. Kopec received a call from 911 in reference to a fight in progress at the Black Water Avenue Apartments in Davis.  Upon arrival Kopec met with the victim, Kasia Marie Williams, and was briefed on the incident.  He took photos of the locations and injuries to the victim.  At 4:01 p.m. Kopec obtained a written statement from the victim that summarized that while she was packing up in her house for the day, the defendant arrived at her house and allegedly accused her of stealing from her.  She stated that the defendant allegedly knocked her to the ground and punched her in the head.  After that the defendant left.  At 4:30 Deputy B.T. Zirk obtained a written statement from the boyfriend of the victim stating that the defendant allegedly confronted the victim about stealing from her, elbowed her in the head and then punched her while she was on the ground.  At 5:55 p.m. Cpl. C.S. Hartman obtained a one page written statement from the defendant.  She stated that she went to the Williams’s residence in Davis and at some point her purse came up missing and she allegedly confronted Williams about it.  She states this started a physical fight with the boyfriend tazing her.  She states that she was allegedly attacked and that Williams and the boyfriend were arguing about drugs. There were marks on the defendant indicating that she was in a physical altercation.  A $500 PR bond was posted.

The following cases have been ordered and adjudged in the Tucker County Magistrate Court:

• State of West Virginia verses Kristin Nicole Coleman, Parsons, received judgment of Motion by the Prosecuting Attorney to dismiss – Granted by the Magistrate – No fees charged on the case for one count driving while license suspended or revoked which occurred on Jan 16, 2016. A motion made by the State to dismiss was granted.  This case was heard on Jan. 5 by Magistrate Riley H. Barb.
• State of West Virginia verses John S. Freet, III, Hambleton, received judgment of Motion by the Prosecuting Attorney to dismiss – Granted by the Magistrate – No fees charged on the case for one count misdemeanor offenses for violation of protective order which occurred on July 25, 2017. This case does not meet statutory definition of offense.  This case was heard on Jan. 29 by Magistrate Riley H. Barb.
• State of West Virginia verses Jessica Lynn Gaither, Bayard, received judgment of Motion by the Prosecuting Attorney to dismiss – Granted by the Magistrate – No fees charged on the case for one count expired operators which occurred on Sept. 9, 2017.  A motion by the State to dismiss was granted.  This case was heard on Jan. 29 by Magistrate Riley H. Barb.
• O.Connor verses Goldstein:  On Jan. 18 the court found in favor of Craig E. O’Connor against Clyde Goldstein and Nicole Marie Oliver in the amount of $3,121.30 plus court cost of $120.  This case was heard on Jan. 18 by Magistrate William M. Miller.
