The following citations have been recorded in the Tucker County Magistrate office:

•  Tristen D. Dumire, Elkins, was cited for speeding (29-25) by Deputy C.R. Donelson.  He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
• William A. Goff, Newburg, was cited for expired MVI by Cpl. D.W. Burge.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Codie B. Rohrbaugh, Petersburg, was cited for no MVI sticker by Cpl. D.W. Burge.  He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
• Felicia A. Coleman, Hambleton, was cited for following too closely and no seatbelt by TFC J.J. Schmidle.  She pled no contest to both charges and was assessed fines of $34.50 and court cost of $330.50.
• Felicia A. Coleman, Hambleton, was cited for speeding (38-25) by Cpl. D.W. Burge.  She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Andrew D. Hudnall, Parsons, was cited for no seatbelt by Sgt. C.D. Siler.  He was assessed fines of $25.
• Ishea S. Neal, Jersey City, NJ, was cited for speeding (55-45) by Cpl. D.W. Burge.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Richard L. Vest, Junior, was cited for speeding (29-25) by Deputy C.R. Donelson.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Samuel T. Harris, Belington, was cited for speeding (29-25) by Deputy C.R. Donelson.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Trevor L. Murphy, Montrose, was cited for speeding (29-25) by Deputy C.R. Donelson.  He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
• Daniel C. Marsh, Buckhannon, was cited for speeding (34-25) by Deputy C.A. Teter.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Thomas M. Pinto, Morgantown, was cited for speeding (34-25) by Deputy B.T. Zirk.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Joseph T. Garten, Davis, was cited for failure to yield for emergency vehicle by Cpl. D.W. Burge.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• William R. Brown, Clarksburg, was cited for expired registration by Cpl. D.W. Burge.  He pled no contest and was assessed fines of $5.75 and court cost of $165.25.
• Kayla A. Narigon, Wellsburg, was cited for speeding (64-55) by K.L. Keplinger.  She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Melissa J. Smith, Dryfork, was cited for no registration by Deputy B.T. Zirk.  She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
• Benjamin S. Nelson, Thomas, was cited for no proof of insurance by Deputy B.T. Zirk.  The charge was dismissed with proof shown.
• Chezaray D. Posey, Elkins, was cited for expired MVI and window tint by Cpl. D.W. Burge.  She pled no contest to both charged and was assessed fines of $9.50 and court cost of $330.50.
• Tommy G. Moore, Jr. was cited for running stop sign by R.M. Bunner.  Total fees were $77.
• Bryant S. Hines, Midland, was cited for speeding (69-65) by TFC J.J. Schmidle.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.

The following criminal complaints have been filed in the Tucker County Magistrate Court:

• Paul Andrew Shaver, Morgantown, was charged with the felony count of Forgery; Uttering.  According to the complaint on Tuesday, Jan. 2 Chief Deputy C.R. Donelson on the Tucker County Sheriff’s office, was contacted by Jason Myers in regards to someone forging his father’s business checks.  Ernest Myers stated that on Dec. 29, 2017 three checks were forged and cashed at three separate Mountain Valley Bank locations totaling $10,777.  Mr. Myers further stated that he, nor his wife, had issued the checks.  Donelson observed one of the forged checks had been cashed at the Parsons branch of the Mountain Valley Bank and observed that it had been paid to the order of the defendant.  Shaver’s signature and ID number was also endorsed on the back of the check.  Donelson obtained video surveillance of the transaction and allegedly identified Shaver by his WV ID.  Video surveillance shows Shaver passing the forged check and obtaining $3,345 prior to exiting the bank.  He is under a cash bond of $20,000 which was not posted.
• Paul Andrew Shaver, Morgantown, was charged with the felony count of Counterfeit Check; Uttering.  The compliant states that on Wednesday, Jan. 10 at approximately 8 a.m. Cpl. J.E. Kopec received an investigation from Citizens National Bank in reference to the victim, Randal Lee Grimes, having a counterfeit and uttering check in his business name to the payment of the suspect Paul Andrew Shaver.  Kopec was provided a 13 page document that included a copy of the counterfeited check for this incident, affidavit of forgery and uttering for this incident and other checks of likeness to the counterfeited check cashed by the suspect in other counties. On Thursday, Jan. 11 Kopec traveled to Grimes Enterprises and obtained a one page statement in reference to this investigation. The statement summarized that on Tuesday, Dec. 12, 2017 his company issued a check to Superior Industrial Laundries rendered in the amount of $194.52.  The check was intercepted, along with other business checks, and counterfeited allegedly by the suspect due to the scam being repeated the same way at multiple Citizens National Banks throughout the state by Shaver.  Grimes identified the counterfeit check by wrong check numbers and phone numbers.  On Friday, Jan. 12 Kopec received a written statement from the bank teller that received the counterfeit check.  She allegedly stated that she remembers Shaver came in to cash a check for Grimes made out to him and she asked for ID.  He allegedly showed her his WV ID and he wrote on the back of the check.  Video from the bank was obtained showing Shaver presenting the check, his ID and then receiving money for the check.  It was made out for $3,945.77.  The video shows him receiving the money, placing it in his pocket and exiting the bank.  A 10% cash bond of $8,000 was not posted and a preliminary hearing was scheduled for March 13 before Magistrate Riley H. Barb.
• Nicholas Alan Chewning, Elkins, was charged with two counts of Obstructing an officer and Battery on an officer.  The complaint states that on Saturday, Feb. 17 TFC D.T. Stallings along with TFC C.E. Elliott received a request, through Randolph County 911 Communications to assist members of the Elkins Police Department with a white in color, Chevy Silverado which was failing to yield for a traffic stop in the city of Elkins.  These officers caught up to the suspect vehicle which was failing to yield, traveling north along Shaver’s Fork Rd toward Tucker County.  On this same date at approximately 11:41 p.m. the suspect vehicle came to a halt when his passage was blocked by a Tucker County Sheriff’s Department cruiser.  He was given orders to vacate the vehicle several times and he failed to comply.  He was allegedly removed from the vehicle and placed on the ground where he became highly combative.  He resisted being handcuffed several times then allegedly elbowed an officer.  He was ordered to stop resisting or he would receive a discharge of a department issued tazer.  He allegedly failed to comply and TFC Elliott deployed his issued tazer onto the accused. He allegedly resumed aggression as soon as electrical discharge ceased.  He was ordered to stop resisting a second time which he did not heed.  He was tazed a second time.  He became combative again striking the officers with the free handcuff on his arm.  The officers gained control and restrained him securing him in handcuffs. He posted a $2,500 PR bond and a Bench Trial is scheduled for April 24 at 10 a.m. before Magistrate Riley H. Barb.

The following cases have been ordered and adjudged in the Tucker County Magistrate Court:

• State of West Virginia verses Felicia Ann Coleman, Hambleton, she received judgment of Dismissed-Deferred Sentence for one count simple possession which occurred on Aug. 27, 2017.  She was assessed cost and fees of $165.25.  Probationary period was complete.  This case was heard on March 7 by Magistrate Riley H. Barb.
• State of West Virginia verses Jason Allen Adkins, Hendricks, he received judgment of preliminary hearing waived for one count Entry of building or other dwelling.  This case was bound over to Tucker County Circuit Court.  It was heard on March 5 by Magistrate William M. Miller.
• Woodlands Development Group verses Birch:  The court found in favor of Woodlands Development Group against Gregory Shaffer and Kayla Birch in the amount of $1,306 plus $110 court cost and they must vacate by March 16.  This case was heard on March 1 by Magistrate Riley H. Barb.
