The following citations have been recorded in the Tucker County Magistrate office:
- Gregory P. Sanchez, Alexandria, Va. was cited for speeding (74-65) by K.L. Keplinger. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Sharon G. Sletmach, Baltimore, Md., was cited for speeding (74-65) by K.L. Keplinger. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Edward T. Kachmarck, III, Kerens, was cited for Expired MVI by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Noah D. Kelley, Blandoh, Pa. was cited for speeding (75-65) by TFC J.J. Schmidle. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Conner J. Nestor, Hambleton, was cited for expired driver’s license by Cpl. D.W. Burge. The charge was dismissed.
The following criminal complaints have been filed in the Tucker County Magistrate office:
- Ryan Deann Lower. Parsons, was charged with one felony count of Possession of Controlled Substance with intent to Deliver. According to the complaint, on Saturday, March 24 at approximately 9:49 a.m. Col. D.W. Burge of the West Virginia State Police received a public service call from Tucker County 911 advising a parked black SUV on WV72 near WV38 with the driver slumped over the steering wheel. Burge located the vehicle and observed the engine running and the window partially down. He approached the driver and asked if she was ok. He opened the door and tapped the driver’s shoulder and asked again if she was ok. He observed the defendant allegedly holding a butane torch in her right hand. He allegedly observed a green glass pipe containing a white residue on the driver side floor below the left hand of the defendant. He helped her out of the vehicle and requested EMS to check her. The defendant allegedly advised that she was a diabetic, using insulin, and had smoked from the glass pipe the night before. Burge asked the defendant if she had any weapons and she advised she may have a needle. He conducted a pat search of her and located two small plastic baggies allegedly containing a white crystalline substance appearing to be methamphetamine and one small baggie containing a white in color substance appearing to be a crushed pill. She advised the pill was Subutex and she did not have a prescription for this pill. Burge asked for ID, insurance and registration for the vehicle. She had a driver’s license but advised she did not have insurance, the vehicle was not in her name and she did not know who the license plate belonged to. Burge allegedly located inside the vehicle several small baggies used to package drugs, several glass pipes, snorting tubes and several butane torch lighters. She posted a property/surety bond of $25,000 and a preliminary hearing is scheduled for April 6 at 9:30 a.m. before Magistrate William M. Miller.
- Clinton Lee Pifer, Hambleton, was charged with one felony count of Failure to Register Sex Offender Life Registrant. The complaint states that on Thursday, March 22, the defendant came to the Parsons Detachment of the West Virginia State Police to do his initial sex offender registration. He told Sgt. C.D. Siler that he worked United Talent in Morgantown which is a temp service. He stated they would call him when they had positions available. He allegedly gave the impression that he worked for them often so the information was initially left on his registration. On Monday, March 26, Siler called the temp agency and spoke with the manager to confirm the defendant’s employment. He learned that the defendant last worked for them in December 2016. He was informed that they attempted to give him employment in May 2017 and he did not show up or call. They stated he was put on the “Do Not Call List” at the time. The defendant is required to register in Tucker County due to it being the county of his residency and is required to register for life due to the victim being a juvenile. The defendant knowingly gave Siler misleading and false information about his employment.
- La’Neil La’Jay Capps, Davis, was charged with attempted escape. The complaint states that on March 28 at 8:20 a.m. K.L. Keplinger and Sgt. C.D. Siler of the West Virginia State Police received a report of an attempted escape from the Kenneth “Honey” Rubenstein Center. Both officers were advised that the defendant attempted to escape by allegedly leaving from the custody of several officers and exiting the facility by the Intake outside entrance door. Officers went in foot pursuit and after a short period of time, Capps was taken back into custody outside the facility buildings. Both officers responded to the scene and obtained statements from four Correctional Officers stating that Capps did exit the facility without permission and did attempt to remain outside of custody of the officers assigned to him. He is under a $4,000 cash bond that was not entered.
- Dennis Wayne Watts, Davis, was charged with five counts of False Reporting of Emergency. According to the complaint, on Saturday, March 25 at approximately 10:07 p.m. Tucker County 911 received a call from the defendant regarding a harassment complaint. He allegedly advised Tina Jones, Whom served a DVPO at approximately 8:25 p.m. was calling and harassing him. Tucker County Sheriff’s Deputy C.R. Donelson attempted to contact Watts in regard to this complaint but he did not answer the first call. Donelson attempted three more times and Watts would answer, but would not respond. Watts allegedly attempted a total of five calls to 911. During some of these calls he would not respond to dispatch. Donelson was able to reach Watts through 911. During this call Watts told Donelson that Ms. Jones was harassing his via telephone. During the conversation, Watts allegedly became belligerent and hung up on Donelson. At approximately 11:30 p.m., TFC. J.J. Schmidle and Donelson responded and made contact with Ms. Jones. She stated she never spoke with Watts and the only person she had contact with was her neighbor Mr. Dumire. The officers then responded to the location where Watts was staying. They made contact with the home owner and he told the officers that Jones did call but only spoke with him. He also advised that when Watts found out Jones was on the phone he became irate. The home owner told the officers that Watts had allegedly taken xanax and had been drinking alcohol. Watts was unable to converse with the officers due to this. A cash bond of $2,500 was not posted and a court hearing is scheduled for April 17 at 11 a.m. before Magistrate William M. Miller.
- Dennis Wayne Watts, Davis, was charged with one count Possession of Controlled Substance. According to the statement, on Sunday, March 25 Chief Deputy C.R. Donelson of the Tucker County Sheriff’s office and TFC J.J. Schmidle of the West Virginia State Police executed an arrest warrant on the defendant. While conducting a weapons search Donelson allegedly located a white allergy pill bottle in his pocket along with a red tube/straw containing white residue commonly used to snort controlled substances. Donelson asked him what was in the bottle and he stated there were xanax and valium pills in it. Donelson opened the container and observed what appeared to be xanax and valium pills among other pills. He did not have a prescription on his person for the said controlled substances. He is under a $1,000 cash bond and a court hearing is scheduled for April 17 at 11 a.m. before Magistrate William M. Miller.
- Dennis Wayne Watts, Davis, was charged with two counts of Violation of Domestic Violence Order. The complaint states that on Sunday, March 25 at approximately 5:30 p.m. TFC. J.J. Schmidle and Deputy C.R. Donelson met with Tina Jones and she provided a written statement. She had her ex-boyfriend, Dennis Watts, served with a DVPO on March 24. On March 25 as she drove past where he was staying she advised he was outside and yelled at her as she drove past. She further advised that he also allegedly sent her neighbor over to ask if he could have some xanax. He was place in custody and is under a $500 cash bond. A court hearing is scheduled for April 17 at 11 a.m. before Magistrate William M. Miller.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Emily Jo Heckler: She received judgment of Motion by the Prosecuting Attorney to dismiss – Granted by the Magistrate – No fees charged on the case for one count Obstructing Officer and one count Indecent Exposure which occurred on Feb. 25. Dismissed without prejudice, will be reinstituted if defendant fails to seek or comply fully with all medical and mental health directives. This case was heard on March 28 by Magistrate Riley H. Barb.
- State of West Virginia verses Marshall D. Parsons, Jr.: He received judgment of Dismissed-Plea Agreement for one count Obstructing Officer and one count Misdemeanor Offenses for Violation of Protective Order. This case was heard on March 22 by Magistrate William M. Miller.
- State of West Virginia verses Levi G. McCauley: Received judgment of Preliminary hearing waived for one count Driving while License Revoked – DUI which occurred on March 15. A fee of $10 was assessed to the case and it was bound over to Tucker County Circuit Court. This case was heard on March 22 by Magistrate William M. Miller.
- State of West Virginia verses Marshall D. Parsons, Jr.: received judgment of Guilty-Plea Agreement for one count Violation of Protective Order which occurred on Jan. 27. He was assessed fines of $250 and cost and fees of $165.25 with credit for time served on one day. This case was heard on March 22 by Magistrate William M. Miller.
- State of West Virginia verses Tammy Lynn Wratchford: She received judgment of Guilty-Plea Agreement for one count unlawful injury to or destruction of property with a violation date of Oct. 18, 2017. She was assessed cost and fees of $165.25 and restitution of $100 with credit for time served on one day. This case was heard on March 22 by Magistrate William M. Miller.
