The Parsons City Council discussed taking action on an ordinance that regulates all-terrain vehicles in the city. The ordinance might prohibit the operation of ATVs on any city street, road, or avenue without a special permit. The ordinance might also require registration and proof of insurance.
According to a statement from the city, the ordinance is to prohibit, “hazardous activities and provide special rules, liability and penalties for violations thereof.”
West Virginia state code mandates, “No all-terrain vehicle may be operated in this state: (1) On any interstate highway except by public safety personnel responding to emergencies; (2) On any road or highway with a center line or more than two lanes except for the purpose of crossing the road, street, or highway.”
However, the code also states, “An all-terrain vehicle may be operated upon the shoulder, or as far to the right on the pavement as possible when there is not enough shoulder to safely operate, on any road, street, or highway referred to in subdivision (2), subsection (a) of this section other than an interstate highway for a distance not to exceed ten miles to travel between a residence or lodging and off-road trails, fields and areas of operation, including stops for food, fuel, supplies and restrooms.”
A municipality, such as Parsons, may authorize all-terrain use for specific purposes or events. “A municipality, county, or other political subdivision of the state may authorize the operation of all-terrain vehicles on specified roads, streets, or highways which are marked with centerline pavement markings, other than interstate highways, to allow participation in parades, exhibitions and other special events, in emergencies or for specified purposes.”
The council motioned to send the ordinance to committee and will further discuss the possible action at the next meeting.
The council approved payment of two invoices totaling approximately $30,000. The council considered and approved all of the Harman Fund projects that are included in this year’s budget.
Davisson Brothers Band presented a contract to the council for $3,500 Friday Nights in the Mill Race Park, last concert of the season August 10.
The next Parsons City Council meeting is scheduled for Tuesday, April 17 at 6 p.m.
