The following citations have been recorded in the Tucker County Magistrate office:
- Jeffray D. Burns, Thomas, was cited for following too close and no insurance by Cpl. D.W. Burge. He pled no contest to the first charge and was assessed fines of $4.75 and court cost of $165.25. The second charge was dismissed with proof shown.
- Davis R. King, Louisville, KY, was cited for speeding (74-65) by Cpl. J.E. Kopec. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Michael K. Thompson, Summersville, was cited for speeding (29-25) and no proof of insurance by Deputy C.R. Donelson. He pled guilty to the first charge and was assessed fines of$4.75 and court cost of $165.25. The second charge was dismissed with proof shown.
- Logan W. Smith, Grandview, IN, was cited for speeding (59-45) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Janine M. Morris, Mount Airy, Md. was cited for speeding (74-65) by Cpl. J.E. Kopec. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Deana M. Ritchey, Thomas, was cited for speeding (35-25) by Cpl. D.W. Burge. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Justin W. Sacks, Parsons, was cited for defeat drug screen by Deputy C.A. Teter. He pled no contest and was assessed fines of $10 and court cost of $165.25.
- Jacob N. Cutright, Clarksburg, was cited for expired MVI by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- John M. Plishka, Elkins, was cited for no insurance by Cpl. D.W. Burge. The charge was dismissed with proof shown.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Janice May White, was charged with one felony count of Possession of a controlled substance with intent to deliver. According to the complaint, on Friday, July 6 at approximately 8:48 p.m. Cpl. J.E. Kopec of the West Virginia State Police, observed a vehicle at a gas pump at Sheetz which matched the description of a vehicle operated by a wanted person for multiple felony charges. Kopec ran the license plate and it came back to the accused Janice May White, wife of the wanted person. He observed the vehicle for several minutes then approached to see if it was occupied, it was found to be empty. Officers searched the inside of Sheetz while Parsons Police Officer Dave Gidley watched the back door. The store was found to be clear but the defendant was found in the back of the store and Deputy Teter corresponded with her advising her why and what they were looking for. It was publicly overheard while she was on the phone that she stated to someone on the phone the cops are looking for you. Kopec continued to patrol the area and the car remained at the same gas pump for 25 minutes until she moved to a spot next to Sheetz where Kopec made contact with her. She was observed digging through the vehicle and moving objects around. She was observed either waiting for someone or not wanting to drive her vehicle on public roads because of increased law enforcement in the area. She has now been at Sheetz for over an hour. Kopec made an investigative stop and began questioning the defendant. She went on the defensive and became argumentative. She was asked if she was waiting on her husband and she allegedly stated that she had not heard from him in a while. Kopec asked for consent to search the vehicle and was denied. He requested K-9 assistance and the dog an air search was conducted which led to a positive indication on both driver and passenger side door jams. Officers conducted a search of the vehicle and discovered a pink case in the back seat which contained two separate baggies. In one bag were eleven prepackaged bags of a green leafy substance and the second bag contained two larger bags of the same substance which later tested positive for marijuana. She was placed under arrest for possession of a controlled substance with intent to distribute due to prepackaging. Continued search of the vehicle yielded a night vision spotting scope, the accused cell phone, a black plastic box with magnets on it which could be used to transport drugs in and affix to the underside of a vehicle, several memory cards and two bullets. The vehicle was turned over to her friend who was on the scene at her request. White was transported to the Parsons State Police Detachment for processing and then to the Tygart Valley Regional Jail. She is under a $25,000 cash bond.
- Patricia Ann Tuesing, Parsons, was charged with one count Trespassing, one count Assault and one count Obstructing/Resisting an Officer. According to the complaint, on June 25, Katherine Anne Russell was taking care of June Ann Carr, mother of Gary Carr. Mr. Carr has a protective order against the neighbor across the street, Darlene Crosten due to years of harassment against his mother. The Carr’s dogs got out and the defendant came to the Carr residence with the dogs. It should be known that the defendant is the sister of Mrs. Crosten and it is believed that she lives there as well. The defendant allegedly began to speak with Mrs. Carr and Russell thanked her for bringing the dogs and asked her to leave due to the past issues with the family. The defendant ignored her and continued to engage in conversation with Mrs. Carr. Russell asked her to leave two more times. The defendant asked why and she was informed that she knew why. She allegedly became irate and began to curse at Russell as she walked off making an obscene gesture. A dog got out again and went across the street into the Crosten’s yard where Russell tried to call it back. The defendant began to yell at her telling her she better not come into the yard, that she would assault her. The defendant allegedly came running out into the road and got into Russell’s face cursing her and trying to get her to strike her. Russell went back inside and called the police and stated she was scared for her safety. TFC J.J. Schmidle and Cpl. D.W. Burge responded to the scene and spoke with both parties telling them to stay away from each other. No sooner than the Troopers left the scene, the defendant took the dog over to the Carr residence and tried to apologize. Russell thanked her and again told her to leave. The defendant allegedly became irate once again and began to yell and curse at Russell as she left. (1) The defendant was asked to leave three times before she finally left. (2) The defendant came to the street where Russell was attempting to retrieve a runaway dog and threatened her and tried to get her to fight. (3) She returned to the Carr residence after being told by Troopers to stay off the Carr property. She posted a $1,100 PR bond and a court hearing is scheduled for Aug. 21 at 10:30 a.m. before Magistrate William M. Miller.
- Katherine A. Waybright, Montrose, was charged with multiple counts of False Representation. The complaint states that the defendant knowingly failed to report earnings from employment when filing for unemployment claim weeks ending 5-17-14 and 5-24-14 receiving $548 in benefits for these weeks to which not entitled. As a result of all acts of fraud, she received benefits for 11 weeks for a total overpayment of $3,014. She posted a property/surety bond of $1,500 and a Bench Trial is scheduled for Aug. 30 at 10 a.m. before Magistrate Riley H. Barb.
- Brian Dale Sipe, Belington, was charged with Prohibited person in possession of a firearm, Fleeing on foot and Shoplifting. The complaint states that on Monday, Oct. 2, Sr. Trooper C.E. Elliott, of the West Virginia State Police, entered the Parsons Sheetz store and observed the defendant, who began to act suspicious. The officer knew the defendant from prior dealings. The officer made contact with the defendant and asked if he had paid for the items he was eating, which he stated that he had brought the items into the store with him. The officer asked if he had any outstanding warrants to which he replied “no”.
During the interaction the accused appeared disoriented and to be under to influence of an unknown substance. Elliott observed an unidentified bulky object under the accused shirt in the front waistband of his pants.
Based on previous interactions, the accused is known to carry a firearm which is often located in his waistband. The officer asked the defendant if he was in possession of any firearms and he stated, “I don’t have any guns.” The officer then lifted the front of the accused shirt and allegedly revealed a stainless steel pistol. Upon revealing the pistol, the accused fled from the officer on foot. The officer pursued the accused through the parking lot of Sheetz and Little Andi’s where he continued down Davis Street and onto Poplar. Do to this being a residential area the officer broke off pursuit and returned to Sheetz. The officer returned to Sheetz and was informed that the accused had fled with items from the store totaling $3.48. The officer asked for video of the incident. A criminal history check of the accused found a prior conviction for prohibited persons in possession of a firearm along with two prior convictions for possession of a controlled substance. He is under a cash bond of $1,800 and a Bench Trial is scheduled for Aug. 27 at 11 a.m. before Magistrate Riley H. Barb.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Raymond J. Card:Parsons, received judgment of no contest for one count failure to maintain control which occurred on Dec. 30, 2017 and a no contest plea for one count Certificate of Insurance. He was assessed fines of $204.75 and court cost of $330.50.
- State of West Virginia verses Janice May White:Kerens, received judgment of Preliminary hearing waived for one felony count manufacture/deliver/possess with intent to manufacture/deliver (Schedule I or II Narcotics). A $10 fee was assessed and this case was bound over to the Tucker County Circuit Court.
