The following citations have been recorded in the Tucker County Magistrate office:
- Melissa Tauscher, Thomas, was cited for expired MVI and expired license by Cpl. J.E. Kopec. She pled no contest to both charges and was assessed fines of $9.50 and court cot of $330.50.
- Nicholas R. Arnold, Thomas, was cited for driving suspended and no proof of insurance by Deputy C.R. Donelson. He pled no contest to the first charge and was assessed fines of $100 and court cost of $165.25. The second charge was dismissed with proof shown.
- Logan D. LaFrance, Davis, was cited for speeding (64-55) by First Sgt. K.L. Keplinger. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Randolph K. Westling, Woodbridge, Va. was cited for speeding (74-65) by Cpl. J.E. Kopec. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Luanne R. Bowman, Point Pleasant, was cited for no proof of insurance by Deputy B.T. Zirk. The charge was dismissed with proof shown.
- Evan Rhodes, Parsons, was cited for no seatbelt by Cpl. J.E. Kopec. He pled no contest and was assessed fines of $25.
The following criminal complaint has been filed in the Tucker County Magistrate Court:
- Toby Le Mills, Broken Arrow, OK, was charged with DUI above .15 BAC. According to the complaint, on Friday, June 8, at approximately 7:11 p.m. Cpl. D.W. Burge of the West Virginia State Police and Deputy B.T. Zirk of the Tucker County Sheriff Department were conducting road patrol near Camp Kid on County Farm Road. The officers located a motorcycle accident near the horse farm, and stopped to check on the driver. Burge spoke with Mills and observed the odor of an alcoholic beverage on his breath and he had bloodshot glassy eyes. Burge observed he had several bleeding injuries and contacted Tucker County 911 of EMS to respond. A Preliminary Breath Test was initiated and he failed said test. EMS responded and due to his injuries he was transported by Health Net to Ruby Memorial Hospital. Burge obtained a subpoena from Monongalia County Magistrate, and obtained medical records that showed Mills’ BAC was .225 upon the blood draw at Ruby Memorial. He posted a $1,000 PR bond.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Skyelar David Carrico: He received judgment of Motion by the Prosecuting Attorney to dismiss – Granted by the Magistrate – No fees charged on the case for one count Domestic Battery. Motion by the State to dismiss was granted. He also received judgment of no contest plea agreement for one count unlawful injury to or destruction of property which occurred on May 23. He received a suspended jail sentence of 30 days and unsupervised probation for six months. He was assessed cost and fees of $165.25. This case was heard on July 19 by Magistrate William M. Miller.
- Barbara Mollohan, Fairmont, received judgment of Motion by the Prosecuting Attorney to dismiss – Granted by the Magistrate – No fees charged on the case for one count restricted license. This case was heard on July 25 by Magistrate William M. Miller.
- State of West Virginia verses Victor Scott Arnett: Received judgment of no contest per plea agreement for one count misdemeanor offenses for violation of protective order; repeat offenses which occurred on Feb. 2. He was assessed cost and fees of $192.50. This case was heard on July 19 by Magistrate Riley H. Barb.
- State of West Virginia verses Veronica Ann Collins: Received judgment of guilty plea for one count violation of Personal Safety Order. She was assessed cost and fees of $165.25; jail for 90 days suspended sentence length of 60 days, 30 days jail time to be served at her discretion. Time must be served by Nov. 1 and unsupervised probation for one year. This case was heard on July 26 by Magistrate William M. Miller.
- State of West Virginia verses Ashley Lipscomb: Received judgment of guilty plea for one count Truancy. She was assessed fines of $50 and cost and fees of $165.25. This case was heard on July 20 by Magistrate William M. Miller.
- State of West Virginia verses James French Spalding: Received judgment of guilty plea agreement for one count driving while licenses suspended or revoked and one count no vehicle insurance. He received judgment of dismissed plea agreement for one count new owner must secure registration and title. He was assessed cost and fees of $165.25. This case was heard on July 23 by Magistrate William M. Miller.
