The following citations have been recorded in the Tucker County Magistrate office:
- James T. Miller, Sutton, was cited for speeding (35-25) by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Jerry D. Buckner, Jr., Charleston, was cited for expired MVI by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Tony I. Freet, Parsons, was cited for speeding (35-25) and expired MVI by Cpl. D.W. Burge. He pled guilty and was assessed fines of $9.50 and court cost of $230.50.
- Raymond C. Haderman, Junior, was cited for speeding (79-65) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of$165.25.
- Jay Dee Kinnard, Davis, was cited for leaving the scene by TFC. J.J. Schmidle. He pled guilty and was assessed fines of $10 and court cost of $165.25.
- David J. Scott, Thomas, was cited for leaving the scene by TFC. J.J. Schmidle. He pled guilty and was assessed fines of $10 and court cost of $165.25.
- Ernest M. Kushevski, Chantilly, Va. was cited for speeding (56-45) by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Samuel B. Petsonk, Charleston, was cited for expire registration by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Brendon H. Corbett, Hendricks, was cited for window tint 15% and no insurance by Cpl. D.W. Burge. He pled no contest to first charge and was assessed fines of $4.75 and court cost of $165.25. The second charge was dismissed with proof shown.
- Caleb D. Burns, Thomas, was cited for no seatbelt by Cpl. J.E. Kopec. He pled guilty and was assessed fines of $25.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Scott A. Poling, Harman, was charged with one count DUI. According to the complaint, on Thursday, Aug. 9 at approximately 5:15 a.m. Deputy C.A. Teter was dispatched to a motor vehicle crash on US219 at Wild Maggie turn. Upon arrival Teter observed the defendant being treated by EMS/Fire personnel for injuries sustained in the crash. Teter asked the defendant what happened and he allegedly stated that he had fallen asleep and ran off the road. Teter noticed that his speech was slurred and eyes were bloodshot and glassy. The defendant allegedly stated that he had drank four to six beers, but allegedly told fire department personnel that he had drank eight to ten beers. The vehicle was in the ditch and several empty beer cans were around said vehicle. Poling was transported to Davis Medical Center due to his injuries. A search warrant was obtained for the medical/toxicology records for Poling and he had a BAC of .127%. He posted a $300 PR bond.
Calvin Lewis Hilliard, Oakland, Md. was charged with one count of Reckless Driving and one count of Driving under the influence of alcohol, controlled substances or drugs. The complaint states that on Saturday, June 30 at approximately 10:25 p.m. officers were dispatched to Black Water Canyon Trail in Thomas for an ATV accident. Deputy B.T. Zirk of the Tucker County Sheriff’s office responded. Upon arrival he met Deputy C.A. Teter and DNR Officer Osalis. PVFD, DVFD and EMS were on scene and were treating two individuals, the defendant and a 17 year old juvenile. The juvenile was transported to Garrett Regional Medical Center for injuries. When asked by Zirk if he had been operating the vehicle at the time of the accident, the defendant said he had been. He was asked if he had been drinking and he allegedly stated that he had. When asked how much he had to drink he stated, “I do not keep track.” He submitted to a Preliminary Breath Test and had a reading of .236. He was then transported to Garrett Regional Medical Center by EMS. He posted a $1,500 PR bond and a pretrial is set for Nov. 16 at 9:30 a.m. before Magistrate William M. Miller.- Clyde Earl Goldstein, Davis, was charged with one count Driving Revoked for DUI. According to the complaint, on Monday, Oct. 8 at approximately 12:20 a.m. Cpl. D.W. Burge was parked along WV32 at the Davis Fire Department and observed a vehicle traveling south with the defendant driving. Burge had prior knowledge that the defendant’s license was revoked for DUI. He initiated a traffic stop and asked Goldstein for his license, registration and insurance card. The defendant allegedly said he didn’t have any information with him at the time. Burge asked if his license was valid and he stated it was revoked for DUI. He posted a $500 PR bond and a hearing is scheduled for Nov. 16 at 10 a.m. before Magistrate William M. Miller.
- Garry Ronald Moore, Parsons, was charged with one count of Domestic Battery. The complaint states that on Tuesday, Oct. 2 Chief Deputy M.J. Sigley was dispatched to 9711 Mountaineer Highway in reference to a domestic situation. Upon arrival he spoke with the defendant, who was sitting on the porch speaking with a DNR officer. He allegedly advised he did not know what was going on. Sigley spoke with Donna Moore and she advised that the defendant allegedly struck her in the face. He did notice a red mark and swelling around left eye. The defendant posted a PR bond of $500 and a bench trail is scheduled for Dec. 4 at 11:30 a.m. before Magistrate Riley H. Barb.
- Michael Scott Moore, Parsons, was charged with one count DUI. According to the complaint on Sunday, Aug. 5 at approximately 1:53 a.m. TFC J.J. Schmidle was dispatched for a one vehicle crash. The defendant had to be extricated from the vehicle. He could not climb the embankment so he was placed in a rescue basket and pulled up. He did not appear to be injured but was unsteady on his feet. He appeared to be under the influence and allegedly advised he had drunk a few. Schmidle requested a preliminary breath test from Moore, which he failed. He was transported to David Medical Center. He posted a $1,000 PR bond and a bench trial is scheduled for Dec. 17 at 10:30 a.m. before Magistrate Riley H. Barb.
The following cases have been ordered and adjudged in the Tucker County Magistrate office:
- State of West Virginia verses Kandice Lee Sponaugle: She received judgment of no contest for one count operation without certificate inspection or failure to produce certificate. She was assessed fines of $4.75 and court cost of $165.25.
- State of West Virginia verses Thomas B. Summerfield, Jr.: He received judgment of no contest plea for one count driving while license suspended or revoked. He was assessed fines of $100 and court cost of $165.25.
The following marriages have been recorded in the Tucker County Clerk’s office:
