The following facts are provided in response to recent and ongoing allegations that the Tucker County Commission has claimed assets of the Tucker County Senior Center.
West Virginia State Code 18-5-7 dictates that disposal of property owned by a county Board of Education must be sold at public auction or deeded to a government agency.
In 1987 and 1990 the Board of Education of Tucker County conveyed property adjacent to Third St. & Spruce St., Parsons, WV (Parcel 1 & 2) to the Tucker County Commission for the exclusive benefit of the Tucker County Senior Citizens and the Tucker County Health Dept. A reversion clause in the deed states,“If at any time the property is not used for those purposes, the property reverts back to the Board”.
In November of 2013, Parcels #1 & #2 were conveyed to the Tucker County Building Commission in order that the property could legally be pledged as collateral for the $1,380,742.00 loan required by the Tucker County Senior Citizens for the construction of the new Veterans Administration Clinic.
December 6, 2013 – Lease Agreement signed between the Tucker County Building Commission and Tucker County Senior Citizens giving them management authority over the VA project.
In accordance with Lease Assignment #1 – V.A. Lease of December 20, 2013
Tucker County Senior Citizens did assign, transfer, and set over unto the Mountain Valley Bank, N.A. all right, title and interest in, to and under the Lease etc. until the loan is fully satisfied.
In accordance with Agreement & Lease dated December 6, 2013 between Tucker County Building Commission and Tucker County Senior Citizens, Article 6, Section 6.02., Books & Records: The Tucker County Senior Citizens will serve as the Managing Agent of the new Veterans Clinic and keep books and records of the Facilities, Project and Equipment.
The Tucker County Commission and the Tucker County Building Commission provided support to insure successful completion of the VA project. Both entities recognize and commend the efforts and success of Senior Center staff who wrote the proposal for the new clinic.
