The following criminal complaint has been filed in the Tucker County Magistrate Court:
Tracey Lea Elza, Kerens, has been charged with four felony counts of Forgery, four felony counts of Uttering and four felony counts of Uniform Controlled Substance Acts- Fraud, Deception. According to the complaint, on Monday, Aug. 13 at approximately 4 p.m. Cpl. J.E. Kopec was assigned a case involving the suspect; Tracey Lea Elza, forging the victim; Susan Ann Schmitt’s prescription pad four times and filling the prescriptions of hydrocodone and oxycodone at Tucker County Community Care, Parsons Rite Aid and Elkins Rite Aid. At 4 p.m. on the same date He was provided exhibit one by the victim which is four pages of prescriptions that were forged by the defendant in order according to the dates from oldest to newest, occurring in June and July. The prescriptions totaled 90 count hydrocodone and 30 count oxycodone. Kopec obtained one page copy of messages to the victim from the suspect which displays the suspect allegedly apologizing to the victim. Kopec was provided a two page statement from Schmitt which summarizes that she received a call from Rite Aid on Monday, July 30 asking that she stop by and verify a signature on a prescription that had been issued. Schmitt states the signature was forged. Three more prescriptions were obtained. Schmitt confronted Elza and asked why she forged the prescriptions. She allegedly told her that she wrote and filled the prescriptions on Friday and flushed it down the toilet and wrote another on Saturday night took one pill and flushed the rest down the toilet. Schmitt asked for Elza’s keys and she was fired on the spot for the crime she committed. Allegedly she admitted to Kopec that she did indeed write the four prescriptions on 6-2, 7-6, 7-27 and 7-28. She posted a $44,000 property/surety bond. And a preliminary trial is scheduled for Dec. 11 at 2 p.m.

St. George Medical Clinic verses Cale: On Nov. 19 the court granted Dismissed Pursuant to Rule 15(a) against Aaron Cale. Service of summons and complaint has not been made upon the defendant. No forwarding address available.
St. George Dental Clinic verses Roy: On Nov. 19 the court granted Dismissed Pursuant to Rule 15(b) against Robert Roy. The defendant has filed no answer and the plaintiff has not moved for default judgment.
Jenningston Farm Homeowners verses Mitchem: On Nov. 16 in the above case the court granted judgment Dismissed against Frankie and James Mitchem as both defendants are deceased.
Jim’s All Star verses Adkins: On Nov. 27 the court granted in favor of Jim’s All Star against Jason A. Adkins in the amount of $325 plus $75 court cost.
City of Parsons verses Dishman: On Nov. 16 the court granted Dismissed Pursuant to Rule 15(b) against Joshua Casey Dishman. The defendant has failed to answer and the plaintiff has not moved for default judgment.
Hamrick Public Service District verses Godfrey: On Nov. 16 the court granted Dismissed Pursuant to Rule 15(b) against Carol Godfrey. The defendant has failed to answer and the plaintiff has not moved for default judgment.
St. George Medical Clinic verses Filer: On Nov. 19 the court granted Dismissed Pursuant to Rule 15(a) against Robert Filer. Service of summons and complaint has not been made upon defendant.
St. George Dental Clinic verses Poe: On Nov. 19 the court granted Dismissed Pursuant to Rule 15(b) against Nicole E. Poe. The defendant has failed to answer and the plaintiff has not moved for default judgment.
St. George Medical Clinic verses Cantrell: On Nov. 19 the court granted Dismissed Pursuant to Rule 15(b) against William E. Cantrell. The defendant has failed to answer and the plaintiff has not moved for default judgment.
State of West Virginia verses Ronald Moore: He received judgment of guilty-plea agreement for one count hunting under the influence and dismissed on one count of shooting within 500 feet. He was assessed fines of $100 and court cost of $165.25.
