CHARLESTON, WV – The Public Service Commission Staff, in a filing to the Commission, stated it agreed with the Administrative Law Judge conclusion that Timberline Four Season Utilities (TFSU) “meets the requirements to be placed into receivership.” Staff also agreed that an order placing TFSU into receivership be sought from the Circuit Court of Tucker County as soon as possible. Leslie Anderson, Supervising Attorney of the PSC Legal Division, indicates that she expects the Commission to uphold the ALJ’s Recommended Decision based on the compelling evidence presented at the December 13-14, 2018 Evidentiary Hearing. Barring any unforeseen circumstances, Anderson anticipates the Commission will order Staff to file a petition in Tucker County Circuit Court to place TFSU in receivership immediately after the entry of the Commission’s Final Order, expected on Tuesday, February 19, 2019.
Quality Water Services, LLC, the current water provider to TFSU customers, indicated its concern that recently a $4,500 check from TFSU for services rendered in December 2018 was returned for insufficient funds. The Commission is appreciative of Quality Water Service’s willingness to continue to serve the community in spite of the financial difficulties this situation has imposed on Quality Water.
Commission Staff has also been in touch with Canaan Valley Public Service District to confirm it is still willing to become the receiver for both water and sewer services if TFSU is placed in receivership.
