Nicholas Scott Poe, a resident of Hambleton, has been charged with one felony count of Fleeing with Reckless Indifference in a vehicle. According to a criminal complaint from Barbour County, on Sunday, Nov. 18 at approximately 10:22 p.m. Senior Trooper Cody C. Mayle was contacted by Barbour 911 and was advised of an active pursuit traveling south on US119 from Taylor County, entering Barbour County. Mayle responded and situated his cruiser in the northbound lane of US119. He witnessed a black pickup traveling south and failing to yield to a Taylor County Deputy. Mayle observed the pickup travel left of center into the northbound lane. He put his cruiser into reverse exiting the northbound lane into a parking lot, avoiding the pickup from striking his cruiser.

He pursued and caught up to the vehicle on US119. An emergency stop was attempted with the vehicle still failing to yield and increasing in speed to 80 mph in a 55 mph zone. Mayle observed the vehicle go left of center numerous times. Poe allegedly continued to flee on US119 until he made a right hand turn onto John St. and traveled south onto Cherry Hill Rd. continuously going left of center and almost striking several vehicles. The officer witnessed the suspect vehicle on Cherry Hill Rd. going approximately 60 mph in a 25 mph posted speed zone.

Poe was pursued toward Upshur County with the vehicle going left of center numerous times and still failing to yield to lights and sirens. Mayle witnessed the pickup exit the southern roadway edge of US119 just past the intersection of Garlyn Loop and US119. Poe allegedly exited the vehicle and began to flee on foot into the woods. Mayle, along with Philippi Police Department Patrolman C. Curkendol were able to apprehend the suspect and place him in custody without further incident.

He was arraigned before Magistrate Kay Hurst and bond was set at $30,000 cash or surety.
