The following citations have been recorded in the Tucker County Magistrate office:
Lori B. Prendergast, Elkins, was cited for selling alcohol to underage person by TFC J.J. Schmidle. She pled no contest and was assessed fines of $25 and court cost of $175.25.
Benjamin S. Nelson, Thomas, was cited for expired registration by Cpl. D.W. Burge. He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
The following criminal complaint has been filed in the Tucker County Magistrate Court:
Nicholas Ryan Schoonover, Parsons, was charged with one count DUI 1st Offense, one count Obstructing and one count Disorderly Conduct. According to the complaint on Sunday, Dec. 29 at approximately 7:13 p.m. Trooper C.R. Donelson was dispatched for a motor vehicle accident on WV72. Upon arrival he was met by Sgt. G.S. DeWeese and Cpl. B.T. Zirk advised he detected the odor of an alcoholic beverage emitting from Schoonover’s breath. He conducted field sobriety tests which were all failed. He also advised that he administered the preliminary breath test on the defendant whereas he blew a .139 BAC. The defendant allegedly had bloodshot, glassy eyes and was slurring his speech. Donelson arrested him for DUI 1st offense and transported him to the Parsons City Building in order to administer the Intoximeter EC/IR II. While en route the defendant became verbally and physically aggressive and began head butting the back of Donelson’s driver’s seat, and Donelson advised him to stop multiple times. Upon arrival at the Parsons City Building, the defendant began shouting profane language outside the building and was told to stop multiple times and he refused and continued to use profane language. The defendant was then administered on the Intoximeter EC/IR II with a submission of .119% BAC. The defendant was then transported to the WVSP/Parsons Detachment for processing and then to Tygart Valley Regional Jail. He is under a $650 cash bond.

State of West Virginia verses Dillon Clarence Waybright, Parsons, received judgment of Probable Cause found for 60 felony counts of Child Abuse Resulting in Injury and 60 felony counts of Conspiracy. This case was bound over to the Tucker County Circuit Court.
State of West Virginia verses Melissa Lee Waybright, Parsons, received judgment of Probable Cause found for 60 felony counts of Child Abuse Resulting in Injury and 60 felony counts of Conspiracy. This case was bound over to the Tucker County Circuit Court.
Hymes-Leary DBA Mountain Momma verses Gilbert DBA Gills Pit Beef: On December 13 court granted judgment in favor of Carrie R. Hymes-Leary DBA Mountain Momma Shaved Ice in the amount of $503.50 plus $80 court cost against Tom Gilbert DBA Gills Pit Beef.
