The following citations have been recorded in the Tucker County Magistrate Office:
John J. McMoon, Chantilly, Va. was cited for speeding (29-25) by Trooper C.R. Donelson. He pled no contest and was assessed fines of $4.75 and court cost of $175.25.
Brady L. Grogg, Meadowbrook, was cited for no operators and no seatbelt by Trooper C.R. Donelson. He pled no contest to both charges and was assessed fines of $29.75 and court cost of $165.25.
Tyler M. Pennington, Beverly, was cited for speeding (60-55) by Chief Deputy M. Sigley. He pled no contest and was assessed fines of $4.75 and court cost of $175.25.
Cynthia L. Huffman, Harman, was cited for speeding (29-25) by D.A. Sliwinski. She pled no contest and was assessed fines of $4.75 and court cost of $175.25.
Angela G. Queen, Weston, was cited for speeding (69-65) by TFC J.J. Schmidle. She pled guilty and was assessed fines of $4.75 and court cost of $175.25.
Micki D. Nelson, Thomas, was cited for driving suspended 1st by Chief Deputy M. Sigley. He pled no contest and was assessed fines of $100 and court cost of $175.25.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
John Thompson, Parsons, was charged with one count of Telephone Harassment. On Wednesday, May 27, 2015 at approximately 10 p.m. Cpl. J.E. Kopec responded to the Collins residence in reference to a telephone harassment complaint from the suspect, John Thompson. Kopec arrived on scene and obtained a one page hand written statement from Miss Collins summarizing that Thompson was sending her pictures of himself in compromising positions and asking her to date him. She stated she did not like this and wanted him to stop. She advised she did send him a text to tell him to stop but he did not. She advised the last message he sent he was approximately two weeks prior to the reporting of this investigation. Kopec was shown a brief video that Collins alleges was sent by Thompson after being told to stop doing so. She advised that she met him on Facebook. Thompson was called by Kopec but he did not respond or return the call. Kopek was informed by Sgt. C.D. Siler that on the date this report was filed at approximately 4 a.m. Collins showed Siler multiple text messages that Thompson allegedly sent her after being told to stop. Thompson posted a $1,500 PR bond and a court hearing is scheduled for March 5 at 10:30 a.m. before Magistrate William M. Miller.
Misty Dawn Eichelberger, Reedsville, was charged with one count Domestic Battery. On Monday, Jan. 6, Cpl. B.T. Zirk of the Tucker County Sheriff’s Office (TCSO) received a domestic battery complaint that occurred at the Davis Thomas Elementary Middle School (DTEMS) from Scott Eichelberger (victim/complainant). He explained the situation that occurred earlier that evening. Zirk and the victim arranged a meeting the following morning, (Jan. 7), to obtain a statement regarding this complaint. Later this evening Zirk was contacted by Tucker County Communications (911) to respond to the Tucker County Magistrate office to pick up a Domestic Violence Protective Order (DVPO) to be served on Mr. Eichelberger. In the morning of Tuesday, Jan. 7 Zirk responded to Mr. Eichelberger’s residence and he then served and explained the DVPO to him. Zirk then proceeded to obtain a hand written and signed statement for the victim regarding the Domestic Battery complaint. He stated after the game ended and he and his daughter approached his son to talk to him, he would not talk so he followed his son out and said let us talk. Misty Eighelberger followed and as they were going out the door she turned and shoved him back through the door causing him to almost run over his daughter. Mr. Eichelberger further stated he did not put his hand on either of them. On Wednesday, Jan. 8 Zirk contacted the DTEMS principle requesting any video footage that may have been collected regarding this incident. The principle located this footage and provided it to Zirk. He reviewed the footage and observed what appeared to be Mr. Eichelberger being pushed backward through the doorway. Ms. Eichelberger posted a $500 PR bond.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
State of West Virginia verses Martin Chauncey, III, Augusta, received judgment of guilty-plea agreement for one count driving while license suspended or revoked and one count no vehicle insurance. He was assessed fines of $350, court cost of $350.50, suspended jail term of 30 days and unsupervised probation of one year. This case was heard on Jan. 20 by Magistrate William M. Miller.
State of West Virginia verses Eddie Ray Collins, Elkins, received judgment of guilty plea for one count knowingly or intentionally possessing a controlled substance without a valid prescription. He was assessed court cost of $175.25, a jail term of 90 days, suspended sentence length of six months Community Corrections. He must report to Day Reporting for six months. This case was heard on Jan. 22 by Magistrate William M. Miller.
State of West Virginia verses John Howard Collett, Jr., Thomas, received judgment of no contest plea for one count making, issuing worthless checks. He was assessed fines of $1 and court cost of $200.25. He must make restitution of $45.
State of West Virginia verses William Jack Plum, Elkins, received judgment of guilty plea for one count driving a vehicle while in an impaired state but with alcohol concentration of less than .15. He was assessed fines of $100 and court cost of $240.25. This case was heard on Jan. 22 by Magistrate William M. Miller.
