The following citations have been recorded in the Tucker County Magistrate office:
Dylan J. Simmons, Parsons, was cited for expired MVI and no insurance by Cpl. J.R. Wince. He pled no contest to both charges and was assessed fines of $204.75 and court cost of $350.50.
Frank O. Acyenang, Woodbridge, Va. was cited for speeding (69-65) by TFC J.J. Schmidle. He pled no contest and was assessed fines of $4.75 and court cost of $175.25.
Samuel C. Parrish, Beverly, was cited for speeding (29-25) by Cpl. B.T. Zirk. He pled no contest and was assessed fines of $4.75 and court cost or $175.25.
Carry M. Arbogast, Parsons, was cited for cell phone use and no seatbelt by Cpl. J.R. Wince. He was assessed fines of $125.
William C. Demoss, Parsons, was cited for fishing without a license by WVDNR. He was assessed fines of $20 and court cost of $175.25.
The following criminal cases have been filed in the Tucker County Magistrate Court:
Ellis R. Hedrick, was charged with one count of fleeing on foot. The complaint states that on Dec. 20, 2019, Sheriff Brian K. Wilfong and Probation Officer Brian Thompson went to Tammy Wratchford’s residence located on Battle St. to serve a warrant on the defendant. Wilfong knocked on the door and the defendant came to the door and Wilfong advised him he was there with an active warrant for his arrest. The defendant allegedly ran on foot to avoid being arrested. The officers were unable to catch him. He posted a $1,000 PR bond and a Bench trial is scheduled on March 24 at 11:30 a.m. before Magistrate Riley H. Barb.
Chad Kenneth Shiflett, Thomas, was charged with one count DUI 1st. According to the complaint on Saturday, Feb. 22 at approximately 9:40 p.m. TFC J.J. Schmidle was on road patrol on US219 when he observed a vehicle travel left of center. He conducted a traffic stop and while conversing with the driver Schmidle could smell alcohol on the defendant’s breath. Field sobriety tests were conducted and the defendant failed all three. The officer conducted a PBT test on the defendant with a result of .138% BAC. The defendant was placed in custody and transported to the Parsons Police Department to administer a secondary chemical test. Shiflett signed the implied consent form and the secondary test resulted a .113% BAC. Shiflett was transported to the West Virginia State Police Parsons Detachment for processing and then onto Tygart Valley Regional Jail. A $500 PR bond was posted and a court hearing is scheduled for April 14 at 10 a.m. before Magistrate William M. Miller.
Victoria D. Ervin, Philippi, was charged with two counts making, issuing worthless checks in the amount of $51.00 and $109.73. A $200 PR bond was posted and a Bench Trail is scheduled for March 5 at 1:30 p.m.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
State of West Virginia verses Darrell Gene Spitznogle, Davis, received judgment of Probable Cause Found for one felony count 1st Degree Sexual Assault and three felony counts Sexual Abuse 1st Degree. This case has been transferred in the Tucker County Circuit Court.
Bonner verses Pennington: The court found in favor of Linda Bonner in the amount of $2.961.44 plus $95 court cost against Ben Pennington. This case was heard on Feb. 25 by Magistrate Riley H. Barb.
West Virginia University Hospital verses Barkley: Received judgment in favor of WVU Hospital in the amount of $728.45 plus $75 against Taylor Quaid Barkley. This case was heard on Feb. 24 by Magistrate William M. Miller.
