The following criminal complaint has been filed in the Tucker County Magistrate office:
Douglas Leon Gidley was charged with one count driving under the influence of alcohol with BAC greater than .15.
On Wednesday, Aug. 23 Cpl. J.J. Cornelius arrived at the scene of a reported crash near Spruce Street in Parsons. Upon arrival, he met with individuals who indicated the driver allegedly attempted to leave the scene and appeared intoxicated. The officer observed a red vehicle over the embankment and had traveled through a fence and into a yard.
The officer made contact with the driver and identified him as Douglas Gidley by his WV driver’s license. He noticed that the suspect had red, glassy eyes and slurred speech. Insurance and registration was requested and the suspect fumbled in the glovebox but was unable to provide the information. The suspect allegedly admitted to the officer several times that he had been drinking.
The officer observed the suspect had difficulty exiting the vehicle and required assistance walking. Field sobriety tests and a portable breath test were administered but all were failed.
Cornelius transported the accused to the Parsons Police Department for secondary chemical testing. After the West Virginia Implied Consent Statement was read and completed, the accused decided to provide a sample to the Intoximeter. The results showed a BAC of .166%.
This crime was committed in Tucker County and all suspects are presumed innocent until proven otherwise in a court of law.
