Following a Grand Jury Indictment on seven charges, Crystal Hinkle, appeared in court on November 15th. The charges included Fraudulent Registration of a Vehicle, Possession with Intent to Deliver and Driving While Revoked for DUI.
Last month, Hinkle had failed to appear following her Grand Jury Hearing. There was some confusion noted in the court over whether she had been formally informed of the appearance date which led to the rescheduling of the hearing.
Hinkle appeared in person along with her attorney Morris Davis. Judge Courrier asked if the defendant had a copy of the Indictment. The defense indicated that they did not. The defense waived the reading of the indictment. The court granted the Grand Jury minutes in accordance with the rules because the witness will be testifying during the case.
The issue of bond was addressed during the hearing. Tucker County Prosecuting Attorney Savannah Hull Wilkins requested cash bond as well as Community Corrections supervision and registering with the State Patrol barracks. The defense objected to the proposal of Community Corrections supervision. “I don’t think her non appearance would be a concern for the court,” Davis said.
Judge Courrier took the middle ground on the issue of bond. “I’ll split the difference,” Judge Courrier said. He ordered a PR Bond of $10,000 with Community Corrections for, “supportive services and any monitoring she may need,” Judge Courrier said. Hinkle was also ordered to report to the State Police Barracks. Wilkins said she would have her office contact the State Police and inform them that Hinkle would be coming by after court.
Judge Courrier asked the attorneys if there would be any suppression motions in the case and both attorneys indicated that there would not be. According to Wilkins, Hinkle left the scene and no statements were taken at the time of the incident. “She left the scene and there were no statements from her,” Wilkins said.
Hinkle was initally charged with Fictitious Inspection and Driving While Revoked. Hinkle was scheduled for a follow up hearing in December.
