The following criminal complaints have been filed in the Tucker Magistrate office:
- Nicole I. Loulis, of Parsons, was charged with 3 counts of Misdemeanor offenses for violation of protective order; repeat offenses. The complaint states that on Monday, Aug. 18 at approximately 1:37 p.m. Lt. C.A. Teter received a complaint from the Tucker County 911 Center of a possible violation of an Emergency Protective Order. He responded to the home and was advised that Nicole Loulis showed up to the residence and while there sat on the porch and spoke with her juvenile daughters, who are the protected persons from the above reference protective order. The suspect was served on Aug. 17, 2025. This incident was recorded on the home surveillance camera system.
- Alva Andre Nelson, Jr., of Davis, was charged with one count DUI First Offense, one count Distracted Driving – Electronic device, and one count Expired Registration. The complaint states that on Tuesday, July 8, 2025 at approximately 7:20 p.m. Trooper R.S. Musgrave was dispatched by Tucker 911 to a single vehicle rollover in the Canaan Area. He was advised that the driver was out of the vehicle at this time.
At approximately 7:36 p.m. Musgrave arrived on scene and located the driver. He acknowledged the odor of an alcoholic beverage, glassy eyes and slowed/slurred speech. He asked the driver if he has previously been drinking, to which the driver allegedly uttered that he had three beers.
At this time, Musgrave began running Nelson through SFST’s, which he failed. At this time, he utilized his state issued PBT for Nelson and the result was .166. The suspect’s phone was unlocked and Musgrave noticed he had been in the act of sending a text while operating his vehicle. The suspect also stated to Musgrave that he had been using his phone while driving.
Nelson was transported by Tucker County EMS to Davis Medical Center and another officer met him there and at that time Nelson signed an affidavit for a blood draw to be collected. This sample was submitted into evidence at the WVSP Parsons Detachment and toxicology on this sample on Thursday, Aug. 14 received the results from the lab. This report states that the suspect had a BAC of .136 at the time of the blood draw.
The above crimes were committed in Tucker County and all individuals are presumed innocent until proven otherwise in a court of law.
