Criminal Complaints

The following criminal complaints have been filed in the Tucker County Magistrate Office:

Gary Ray Bonnell was charged with one felony count Strangulation, one felony count Suffocation, one count Asphyxiation and one count of Battery. According to the complaint, on Sunday, Oct. 5, Cpl. C.R. Summerfield of the Tucker County Sheriff’s Office (TCSO) was dispatched by Tucker County Communications (911) for an active altercation. 911 advised that it was a physical altercation and someone was actively being choked. A few moments later 911 advised that the aggressor had fled the scene in a white Ford SUV.

Summerfield and Trooper R.K. Stewart of the West Virginia State Police (WVSP) located said vehicle on Billings Ave. in Parsons. Summerfield stopped the vehicle and asked the driver if he was involved in a fight. The driver, later identified by his WV Operators to be Gary Bonnell, stated that he was involved in a fight. Summerfield requested the suspect to step out of the vehicle and asked what had happened. The suspect stated that he was going to his girlfriend’s house, while there a male subject approached him with a knife in his hand. The suspect further stated that two females approached him with objects in their hands. He stated that he hit the male in the face one time in self-defense.

Officers spoke with the male subject who stated that the suspect arrived at his residence and began yelling at one female, he said he approached the suspect and was struck in the face several times. He further stated that the suspect pinned him to the ground and proceeded to choke him yelling, “I am going to kill you.” The male subject stated that the suspect placed both hands around his throat for approximately five to six seconds. He said pain during the strangulation was a seven out of 10. He was unable to breathe or talk while the suspect was strangling him. Trooper Stewart obtained photographic evidence of the marks/redness on his neck along with redness/abrasions on his back. The male subject stated that he felt nauseous after the incident and noticed to have a raspy voice or “tickle” in his throat. He stated that one of the females pulled the suspect from him.

The female stated that she observed the suspect strike the male and choke him. She also stated that she heard the male struggling to breathe during the strangulation. She also stated that she witnessed the incident take place and observed the suspect strike the male and strangle him. The male denied EMS care.

James Edward Sisler, of Aurora, was charged with one count Grand Larceny. The complaint states that on Wednesday, June 25 at approximately 1 p.m. Trooper R.K. Stewart received a complaint from the victim in reference to him hiring and paying James Edward Sisler to come and extend the basement at his residence.

He advised Stewart that he paid the defendant $17,000 via certified check to extend his basement and pay for materials needed to complete said job. He advised the Trooper that he had been in contact with the defendant regarding his basement extension since July 2024. He stated that he and the defendant had agreed to terms over text messages, which he had printed out and provided to the Trooper. He claimed that the defendant had come to his residence and stated that he would need a down payment of $17,000 for materials and provided him with said amount. The defendant said that he would work on said project, took the money and never returned and finished the job.

He advised that when the defendant came to his residence, he told the victim that he would need to hire another contractor to dig the hole because he did not have the proper equipment.

On Monday, July 14 Stewart went to the victim’s residence to photograph the unfinished work and he observed an already dug hole beside the residence, said hole was filled with water and mud. The victim stated that he had hired a separate contractor to dig the hole in preparation for the services the defendant was supposed to provide.

On Monday, Aug. 25 Stewart obtained a search warrant for the defendant’s bank account and on Tuesday, Aug. 26 the warrant was served for the bank account. On Wednesday, Aug. 27 he received the records which showed a deposit of $18,500 on Sept. 9. Said deposit indicates that the defendant deposited the victim’s certified check on that day.

These incidents occurred in Tucker County and all suspects are presumed innocent until proven otherwise in a court of law.

The following property transfers have been recorded in the Tucker County Clerk’s office:

  • Albert M. Espinoza, Dry Fork District, Lot 29 North Face to Jimmie Larch.
  • Canaan Valley Public Service District, Dry Fork District, Final Order of Dismissal Vesting Indefeasible Title – Utility Easement to West Virginia Power & Transmission Company, Monongahela Power Company, Citibank NA Successor in Interest, City Bank Farmers Trust Company, First National City Trust Company, First City Bank and Sheriff of Tucker County.
  • Steven Patoir and Maanvi Patoir, Dry Fork District, Lot 33 to Jonathan Mapley-Brittle and Tracy Mapley-Brittle, $534,000.

  • Larry W. Nestor, Janet Elsanbary/FKA/Janet Mann, Gary Nestor and Jerry C. Nestor, Hendricks Corporation, .25 acres, .50 acres and ½ acre to Christina M. Worrell.
  • West Virginia Annual Conference of the United Methodist Church Board of Trustees, Richard E. Ford, Jr., Trustee, Sheri Kernik, Trustee, Thomas Matthews, Trustee, Hollis A. Biondi, Trustee, Annette Carper, Trustee, Ken Krimmel, Trustee, Randall F. Flanagan, Trustee, Beverly Kerr, Trustee, Frank Shomo, Trustee, Nancy Cheshire, Trustee, Yvonne W.
