Three waive their right to a preliminary hearing in alleged breaking and entering

PARSONS – Three Tucker County men, each accused of allegedly breaking and entering, waived their right to preliminary hearings last week.

Jesse James Burns, 19, of Parsons; Howard Patrick (Trey) Hagan, 20, of Dry Fork; and Cory Allen Lester, 21, of Hambleton were each charged with one count of breaking and entering. The charges stem from a break in on Dec. 12 at the Parsons Detachment of the West Virginia State Police.

All three men appeared separately in Tucker County Magistrate Court and requested a modification of the structure of their $20,000 cash only bond. Tucker County Prosecuting Attorney Ray LaMora III said he did not oppose the modification.

“The state has no opposition to modifying the structure of bond to include personal recognizance,” LaMora said Thursday. “We will require home confinement with work release. Also, each must agree to have no contact with any of the other defendants in this case.”

The charges in these cases may be presented to a Tucker County Grand Jury. All defendants are presumed innocent until or unless found guilty.
