The following criminal complaint has been filed in the Tucker County Magistrate office:
Thomas Neal Collins, of Davis has been charged with one count of Brandishinig. According to the complaint, on Thursday, May 28 at approximately 2:30 a.m., Sr. Trooper R.S. Musgrave was dispatched to the Eagles Clubhouse in Davis. Tucker 911 advised there was some sort of altercation at the bar and that there was a firearm being involved or produced into the situation.
On this same date, the officer arrived at the above-mentioned area and observed members from the clubhouse in the parking area. He spoke to some of the individuals involved and obtained statements. Each statement corroborated that Thomas Collins was at the bar and had possession of a firearm. Each witness stated at some point Collins was asked to leave for the night due to causing some issues. Collins was escorted outside to which he allegedly makes the comment, “I will shoot every ****** in this bar.” Witnesses state that he was escorted to the alleyway across the street where some sort of physical altercation occurred. Witness states that at this time the defendant places his hand on the firearm in his pocket. Witnesses state that at this time the defendant ends up on the ground where he is disarmed and the firearm is unloaded. Witnesses stated they obtained his firearm and told him to leave.
At this time the officer secured the firearm and traveled over to the area where this incident occurred and he located multiple .45 caliber ammunition on the ground along with a pair of broken sunglasses witnesses stated belonged to the defendant.
On this same date, at approximately 5:30 a.m. Musgrave located the defendant at 237 Thomas Avenue where he openly stated to Musgrave that he was at the clubhouse earlier that morning, that there was some sort of altercation that occurred, and he did have possession of a firearm during this incident. All statements are captured on body cam.
