The following criminal complaint has been filed in the Tucker County Magistrate office:
Angeline M. Mack, was charged with one count of Driving Under the Influence of Alcohol, one count of Driving While License Suspended or revoked 2nd and one count of prohibited acts (possession). According to the complaint, on Thursday, Sept. 17 Cpl. C.R. Summerfield received a complaint for a reckless driver. The caller stated that a Subaru was driving all over the road and had hit the guardrail. While en route he observed a Toyota traveling south on US219, the caller was behind the vehicle pointing at it out of the window. The officer turned and followed behind the vehicle with several vehicles between them. He observed a grey Toyota turn onto WV72. While traveling he observed the vehicle sitting at the Holly Meadows intersection. The vehicle then turned back onto WV72, then turned onto US48. While behind the vehicle he observed it swerving left of center numerous times while at the on ramp and not keeping a consistent speed.
He activated his lights and initiated a traffic stop on the vehicle. He made contact with the female driver who stated that she did not have her ID with her but stated that her name was Angeline Mack. Upon speaking with her he could smell the odor of alcohol. He provided her information with Tucker 911 who advised that her privilege to operate a motor vehicle was revoked for DUI effective Sept. 28, 2021 and suspended effective March 26, 2025.
Sgt. Zirk arrived on scene and while speaking with the driver she requested to step out of her vehicle and show the officers the damage to her vehicle. When she exited the vehicle, the officers observed her to be unsteady on her feet.
Summerfield directed her to complete a series of field sobriety tests and she failed. She did not consent to a preliminary breath test and she was placed under arrest and transported to the Parsons Police Department for the intoximeter. While at the PPD, Summerfield read her the West Virginia Implied Consent Statement. After a period of 15 minutes, she refused this test.
While Summerfield, NRPO Officer Dudley and Cpl. N.C. Gidley were at the PPD with her, Sgt. Zirk and Deputy Sottile remained on scene with the vehicle. Summerfield was advised by Zirk that two multicolored marijuana smoking devices, containers containing a green leafy substance believed to be marijuana and two empty mini liquor bottles located inside the vehicle.
Cpl. B.M. Gidley transported her to the West Virginia State Police in Hambleton for processing and then back to the Sheriff’s office. Summerfield transported her to the Randolph County Magistrates office and obtained a search warrant for a blood draw. She was then transported to TVRJ to await arraignment.
