PARSONS – An Aurora man who pleaded guilty to charges of DUI 2nd Offense and 2nd Offense Driving Revoked was sentenced to 18 months of home confinement, with weekly drug and alcohol testing for one year and a fine and court costs of $560.50.
Coy Ware, 29, of 24419 George Washington Highway, appeared with his attorney, Timothy Gentilozzi Tuesday in Tucker County Magistrate Court.
Ware pleaded guilty to charges of DUI 2nd offense and driving revoked for DUI. Charges of no insurance, failure to obey a stop sign and improper registration were dropped.
Magistrate Riley Barb asked Ware when he received his first DUI.
“I got the first DUI in 2014,” Ware said.
Tucker County Prosecuting Attorney Ray LaMora III said the State recommends Ware be sentenced to two one-year consecutive sentences.
“We further recommend that be suspended for two years on home confinement,” LaMora said. “We ask the first year of that sentence that he is drug and alcohol tested in the day report center in Monongalia County. If there are no issues in that first year, the State would not object to him being released early at one year from home confinement.”
Barb asked Ware if he had anything to say before sentencing.
“Whatever happens today, I know that I need to help myself from drinking alcohol,” Ware said. “I need to make a plan for recovery for the bettering of my family and my children. Whatever you do to me today, I will fulfill it. I will go forward in that direction.”
“I hope you have learned a lesson because that is a hard one to learn,” Barb said. “They have given you a chance. It is going to be tough. It is going to be a pain in the butt. But, get through it and do good things.”
Also in Tucker County Magistrate Court Tuesday:
Eric Lester Mullenax, of Parsons appeared with his attorney James Hawkins. Mullenax was charged with three counts of breaking and entering, taking five bags of wood pellets for a total of $46.54.
Mullenax waived his right to a preliminary hearing, and his charges could be brought before a Tucker County Grand Jury.
A motion was approved to remove Mullenax from home confinement.
