The following citations have been recorded in the Tucker County Magistrate office:

 

  • Robert E. Suesse III, Lavale Md. was cited for passing in no passing zone by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
  • Terrance L. Atkinson, Huttonsville, was cited for speeding (59-45) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $10 and court cost of $165.25.
  • Sierra Whitehair, Harman, was cited for no seatbelt and no proof of insurance by Cpl. J.E. Kopec. She pled no contest to the first charge and was assessed fines of $25. The second charge was dismissed with proof shown.
  • Donald L. Reed Jr., Montrose, was cited for no seatbelt by Sgt. C.D. Siler. He pled guilty and was assessed fines of $25.
  • Fred Kevin White, Parsons, was cited for no seatbelt and proof of insurance. He pled no contest to first charge and was assessed fines of $25. The second charge was dismissed with proof shown.
  • Benjamin S. Nelson, Thomas, was cited for expired registration and expired insurance by Cpl. J.E. Kopec. He pled no contest to both charges and was assessed fines of $9.50 and court cost of $330.50.
  • Bradley W. Tuckwiller, Lewisburg, was cited for speeding (54-45) by Cpl. J.E. Kopec. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.

 

The following criminal complaints have been filed in the Tucker County Magistrate office:

 

  • Derrick Lee Dumire, Hendricks, has been charged with a felony count of Felon in possession of firearm and a misdemeanor charge of possession of a controlled substance/marijuana. According to the criminal complaint, on Thursday, Dec. 10 Cpl. J.E. Kopec and Sgt. C.D. Siler, of the West Virginia State Police, served a protective order on the accused. Allegedly, upon execution of the protective order, multiple firearms were discovered in the residence, including pistols, shotguns and a rifle. Various types of ammunition were also found and Dumire allegedly admitted that the weapons were his. A bag of what is believed to be marijuana was allegedly also found by Siler in the bedroom. The defendant does have a felony conviction of possession of methamphetamine in Florida on Oct. 15, 2003. The evidence of crime was seized and Dumire was arrested then transported to the Parsons State Police Detachment for processing and then to the Tygart Valley Regional Jail. A $5,000 PR bond was posted for the felony charge and a $100 PR bond was posted for the Misdemeanor charge.
  • Phillip Grant Boyles, Kerens, has been charged with Driving suspended for Misc.; Open dump and Mandatory disposal. The complaint states that Cpl. WVDNR T.L. Fluharty observed the open dump at 72 Pheasant Run Road, the residence of John Boyles, in May 2015. He spoke with the defendant and he allegedly said he would have the trash removed within a month, when he got his truck fixed. Then on Aug. 15, Fluharty stopped the defendant driving the truck that was loaded with tires and Boyles allegedly said he would have the dump cleaned up that week. Fluharty made repeated attempts to contact the defendant at the above residence without success. On Nov 18 Fluharty made contact with Boyles and advised him that charges would be forth coming, including a charge of driving suspended.
  • Devin Nole McDaniel, Parsons, was charged with Retaliation of a Public Official and Retaliation of a State Witness. According to the criminal complaint, on Dec. 18, the defendant was on his twitter account and allegedly tweeted, “(A Tucker County School employee) better hope to f****** god I don’t see him in town or he will be getting his a** beat please spread the word to thank him.” Sgt. C.D. Siler was contacted in reference to the investigation of “Solicitation for Murder” of two juvenile boys of the Tucker County High School. The school employee was acting in his official duty as a public employee and is a witness in this investigation. This complaint is based on the information found on the defendant’s Twitter account and other facts from Sgt. C.D. Siler’s investigation.

 

The following cases have been ordered and adjudged by the Tucker County Magistrate Court:

 

  • Corey A. Cochran, Belington, received judgment of No Contest per Plea Agreement for one count unlawful injury to or destruction of property with a violation date of July 24. He must pay cost and fees of $165.25 and restitution of $43.06. The case was ordered and adjudged on Dec. 8 by Magistrate Riley H. Barb.
  • Jennifer A. Benson, Bruceton Mills, received judgment of Guilty-Plea Agreement for one count of DUI with an alcohol concentration in blood greater than .15 (Misdemeanor) which occurred on Nov. 1. She was assessed fines of $100 with cost and fees of $240.50. She received a six month suspended sentence with credit for time served of one day. She must report to the Day Reporting Center of the Preston County Community Corrections for six months. The case was ordered and adjudged on Dec. 14 by Magistrate William M. Miller.
