The following citations have been recorded in the Tucker County Magistrate office:
- Joseph M. Stine, Ridgeweed, NY, was cited for speeding by Deputy B.T. Zirk. He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
- James L. Hart, Leon, was cited for driving suspended by Cpl. D.W. Burge. He pled no contest and was assessed fines of $100 and court cost of $165.25.
- Elizabeth C. Gutierrez, Pleasanton, Texas, was cited for expired registration and no proof of insurance by Deputy C .A. Teter. She pled no contest and was assessed fines of $5.75 and court cost of $165.25. The second charge was dismissed with proof shown.
- Anthony D. Harrison, Middletown, Va. was cited for failure to obey traffic device by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Dylan L. Helmick, Martinsburg was cited for speeding (49-45) and no proof of insurance by TFC J.J. Schmidle. He pled no contest to first charge and was assessed fines of $4.75 and court cost of $165.25. The second charge was dismissed with proof shown.
- Christine G. Hamby, Montrose, was cited for speeding (59-45) by Sgt. C.D. Siler. She pled no contest and was assessed fines if $4.75 and court cost of $165.25.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Nicole Marie Oliver, Davis, was charged with DUI, First offense, on April 25. The complaint states that on Monday, April 25 at 8 a.m. Deputy B.T. Zirk responded to the scene of a vehicular accident on US219 near Silver Fox Road and Luke Mullenax Road. Upon arrival Chief W.D. Rowe was already on the scene with four other people, two of which were occupants of the vehicle involved in the accident. The driver, Nicole M. Oliver appeared to be staggering, had constricted pupils and slurring her speech. Zirk did not smell alcohol on her breath. The passenger of the vehicle, Sereena J. Young, also had slurred speech, staggering and constricted pupils. While conducting the investigation, Oliver stated to Zirk that she has taken Aderal, Subutex and Xanex. Oliver gave a verbal and written consent to a blood draw. She was placed under arrest for Driving Under the Influence (1st) and transported to Tucker Community Care for the blood draw then to the Parsons Detachment of the West Virginia State Police for processing. She posted a $5,000 PR bond.
- Nicole Marie Oliver, Davis, was cited for no proof of insurance by Deputy B.T. Zirk. She posted a $1,000 PR bond.
- Stephen James Plum, Hambleton, was charged with DUI, First offense on April 25. According to the complaint, on Monday, April 25 at 8 a.m. Cpl. D.W. Burge was advised by Tucker County 911 of a motor vehicle accident of US219. Burge traveled to the scene located on US219 near Silver Fox Road and Luke Mullenax Road. Upon arrival Chief D.W. Rowe was on the scene along with Deputy B.T .Zirk and Chief Deputy E.C. Surguy. Burge was advised by Rowe that a second vehicle was on scene, and driven by Stephen Plum. Burge observed Plum to be staggering, had constricted pupils and slurring his speech. Burge did not smell alcohol on his breath. Burge asked Plum if he was under the influence of any controlled substance, and Plum advised that he had Methamphetamine in his system, and his own prescribed medications. Burge conducted field sobriety tests on Plum and he failed said test. Burge offered Plum a blood test for intoxication and drug usage and Plum agreed to said test. He was transported to Tucker Community Care for the blood draw. He was then transported to the Parsons Detachment of the West Virginia State Police for processing. He posted a $6,000 PR bond.
- Heather Nicole Watson, Parsons, was cited for shoplifting, second offense, by Deputy C.R. Donelson. She pled not guilty on April 27.
- Christopher Scott Earnest, Clarksburg, was charged with reckless driving on Dec. 26, 2015. According to the complaint, on Saturday, Dec. 26, Deputy B.T. Zirk was in the Sheetz parking lot handling another situation with a homeless woman when he observed a Chevy Silverado driven by the defendant pull into the parking lot. He was observed getting out of the truck and entering the store. Zirk observed the defendant exit the store and get back in the truck. He entered the three way intersection of US219 and WV72 at which point the officer observed said vehicle rev its engine before spinning and breaking traction with the road, fishtailing around the right hand turn onto WV72. He posted a $55 PR bond.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Venton T. Brooks II, Parsons, received judgment of dismissed by Mag-Joint motion for one count Truancy. This case was ordered and adjudged on April 22 by Magistrate Riley H. Barb.
State of West Virginia verses Delbert M. Moore, Elkins, received no contest plea for one count operation of vehicles with safety belt which occurred on April 24. He was assessed fines of $25 on April 27 by Magistrate William M. Miller. He also received dismissed by Mag-State-No fee for one count driving while license suspended or revoked. DMV Error. - United Hospital Center verses Sherry L. Mauzy: Case was dismissed without prejudice against Mauzy per motion filed by Plaintiff. This case was ordered and adjudged on April 25 by Magistrate Riley H. Barb.
- Miners and Merchants Bank verses Witek et al: The case was found in favor of Miners and Merchants Bank against Amanda J. Fortney and Jamie A. Witek in the amount of $1,906.10 plus $110 court cost. Affidavit for default judgment. This case was ordered and adjudged on April 25 by Magistrate William M. Miller.
- First United Bank & Trust verses Donna Rae Fridley and Matthew Todd Anderson: The court found in favor of First United Bank & Trust in the amount of $1,546.35 plus $110 court cost. Affidavit for default judgment. This case was ordered and adjudged on April 21 by Magistrate Riley H. Barb.
- Poling verses Triplett: The court found in favor of Ronald Dale Poling against Steven Triplett in the amount of $2,500 plus $95 court cost. This case was ordered and adjudged on April 20 by Magistrate William M. Miller.
- State of West Virginia verses Joseph A. Simmons II: He received judgment of guilty plea for one count unlawful injury to or destruction of property which occurred on March 4. He was assessed fines of $100 and court cost of $165.25. This case was ordered and adjudged on April 20 by Magistrate William M. Miller.
