The following citations have been recorded in the Tucker County Magistrate office:
- Joseph L. Moore, Uniontown, Ohio, was cited for speeding (54-45) in a work zone by Cpl. D.W. Burge. He pled guilty and was assessed fines o $100 and court cost of $165.25.
- Hank W. Smith, Beverly, was cited for no registration and no seatbelt by Deputy C.R. Donelson. He pled no contest to both charges and was assessed fines of $29.75 and court cost of $165.25.
- Billy Joe Gibson, Elkview, was cited for speeding (69-55) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Emmett F. Schneider, Washington, DC, was cited for speeding (55-45) by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Brian P. Maner, Parsons, was cited for no insurance by Sgt. J.L. Clay in 2010. He pled no contest and was assessed fines of $200 and court cost of $165.25.
- Emmanuel A. Huffman, Harman, was cited for speeding (74-45) and passing in a no passing zone by Sgt. C.D. Siler. He pled no contest to both charges and was assessed fines of $9.50 and court cost of $330.50.
- Emmanuel A. Huffman, Harman, was cited for concealed deadly weapon and loaded gun in car by Sgt. C.D. Siler. He pled no contest to both charges and was assessed fines of $120 and court cost of $330.50.
- Emmanuel A. Huffman, Harman, was cited for no insurance by Sgt. C.D. Siler. Charge was dismissed with proof shown.
- Robert G. Sines, Gormania, was cited for expired MVI by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Robert G. Sines, Gormania, was cited for driving suspended and no insurance by Cpl. D.W. Burge. He pled no contest to both charges and was assessed fines of $300 and court cost of $330.50.
- Maria B. Ricottilli, Montrose, was cited for cell phone use by Sgt. C.D. Siler. She pled guilty and was assessed fines of $100.
The following felony criminal complaint has been filed in the Tucker County Magistrate Court:
- Jonathan Charles Lambert, Parsons, has been charged with a felony count of Sexual Abuse First Degree. The complaint states that on Wednesday, Feb. 3, Cpl. J.E. Kopec of the Parsons Detachment of the West Virginia State Police was contacted by the victim’s mother in reference to the suspect, Jonathan Lambert sexually abusing her.
- On the same date, Kopec arrived at the victim’s residence and obtained a two page hand written statement from the victim. The statement summarizes that she went to class to work on a project. She allegedly states that the teacher left the room and the suspect walked into the room and immediately approached her. She states that she was by the sink cleaning paint brushes and the defendant allegedly leaned up against her. She states that she told him to get off and he said “Come on let me” and she told him no.
- She next said that the defendant allegedly grabbed her wrists and held them up. She told him to let her go and this is when he stated “come on” and allegedly leaned against her back with his body. He allegedly then began trying to kiss her neck and she pushed him away. At this time the victim went to the Assistant Principal and reported the incident.
- On Thursday, Feb. 4, a three page statement was provided to the Assistant Principal in reference to this investigation for the school.
- On Friday, Feb. 5 Child Advocacy Center interviewer conducted a forensic recorded interview with the victim. Kopec was present and the interview did not differ from the original hand written statement. A more detailed explanation of the defendant pushing himself against her back side was described by the victim.
- The teacher was interviewed and stated that she left to warm up her lunch and the defendant was not present in the class room. She also states that the incident was not brought to her attention upon her return to the room.
- Kopec received a one page hand written statement from the Assistant Principal composed by the defendant. The statement was taken by the Assistant Principal on Thursday, Feb. 4 and it states that the defendant does admit he was in the class room but denies the allegations. He states that the victim allegedly asked him if he wanted a hug and he said no. He states that she hugged him anyway and he told her to “go (explicative) off”. He states that he looked at his watch and saw that it was time to go. He said the teacher was not in the room and he did not see her.
- On Tuesday, Feb. 23 Kopec called the defendant’s residence to set up an interview and his mother said he was unavailable.
- On Wednesday, Feb. 24 Kopec arrived at the residence and asked the defendant if he would provide a statement and he informed Kopec that he had a lawyer and he did not want to give a statement. His bail was set at $7,500 cash and a court hearing is scheduled for Wednesday, March 2 at 10 a.m.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Brandon S. Burns, Oakland, Md. was charged with unlawful use of motorized vehicle on a part of a national forest. According to the complaint, on or about April 18, 2015 the accused allegedly operated a motorized vehicle on national forest lands that are closed to such use in the area of the Arbogast Cave. He posted a $300 PR bond and a court hearing is scheduled for March 16 at 10:30 a.m. before Magistrate Riley H. Barb.
- Brittany L. Burns, Oakland, Md. was charged with Trespassing; Conspiracy against State; 20-7A-2(c): Cave vandalism. The complaint states that on or about April 19, 2015, the accused allegedly rode as a passenger in an off road motorized vehicle on national forest lands that are closed to such use in the area of the Arbogast Cave on two separate occasions. On one occasion, the accused allegedly entered a fenced in area that had a visible sign indicating the area was closed. The accused and three other accused individuals crawled under the fence accessing and entering the closed area, thus causing damage to the fence. This allowed the accused and three other accused conspirators access to the second gate where the accused allegedly stood and watched one of the other accused attempt to cut the second gate open with a hacksaw. Once the accused became aware of the camera they all left the closed area. She posted a $1,500 PR bond and a court hearing is set for March 16 at 11 a.m. before Magistrate Riley H. Barb.
- Sheena Boyles, Parsons, is charged with Compulsory Education offenses; failure to cause a child to attend school. She posted a $500 PR bond and a court hearing is scheduled for March 28 at 10 a.m. before Magistrate Riley H. Barb.
- Venton Brooks II, Parsons, is charged with Compulsory Education offenses; failure to cause a child to attend school. He posted a $500 PR bond and a court hearing is scheduled for March 28 at 10:30 a.m. before Magistrate Riley H. Barb.
- Mindy Durham, Parsons, is charged with Compulsory Education offenses; failure to cause a child to attend school. She posted a $500 PR bond and a court hearing is scheduled for March 28 at 9:30 a.m. before Magistrate William M. Miller.
- Sara Davis, Parsons, is charged with Compulsory Education offenses; failure to cause a child to attend school. She posted a $500 PR bond and a court hearing is scheduled for March 28 at 11:30 a.m. before Magistrate William M. Miller.
- Christina Andrews, Davis, is charged with Compulsory Education offenses; failure to cause a child to attend school. She posted a $500 PR bond and a court hearing is scheduled for March 28 at 11:45 a.m. before Magistrate William M. Miller.
