The following citations have been recorded in the Tucker County Magistrate office:
- Dalton James Roy, Davis, was cited for failure to check deer and conspiracy to violate chapter 20 by Cpl. T.L. Fluharty. He was assessed fines of $40 and court cost of $330.50
- Jaycob L. Tschudy, Scarborough, ME, was cited for no MVI by Cpl. D.W. Burge. The charge was dismissed with proof shown.
- John M. Winslow, Purgitsville, was cited for speeding by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Amanda C. Mullennex, Parsons, was cited for no insurance by Cpl. D.W. Burge. The charge was dismissed with proof shown.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Brian Keith Calvert, Parsons, has been charged with Domestic Battery. According to the complaint, on Monday, Feb. 22 Deputies B.T. Zirk and C.R. Donelson, of the Tucker County Sheriff’s office, were dispatched to Mount Zion Rd for a domestic altercation. Upon arrival the officers made contact with the victim, Monica Thompson, who stated that the defendant/boyfriend Brian Calvert and her was in a verbal altercation when the defendant became mad and allegedly grabbed her by the head and hit it off the kitchen stove several times. The victim was observed to have a busted lip and knot with a cut on her forehead consistent with her statement. The officers attempted and were unable to locate the defendant near the residence after the victim stated he ran into the woods after she called 911. He is under a $3,000 cash or surety bond and a court hearing has been set for April 14 at 11 a.m. before Magistrate Riley H. Barb.
Brian Keith Calvert, Parsons, has been charged with Obstructing Officer; two counts of Obstructing and two counts of Unlawful Restraint. According to the complaint, Deputies B.T. Zirk, C.A. Teter and C.R. Donelson of the Tucker County Sheriff’s Department and Cpl. J.E. Kopec and TFC J.J. Schmidle of the Parsons Detachment of the West Virginia State Police, went to the residence of defendant Brian Calvert. Deputy Zirk had obtained an arrest warrant for Calvert for a Domestic Battery that occurred earlier in the week. The officers went to the residence to execute the warrant, knocked on the door and heard movement inside. The officers went to several doors and announced themselves and after several minutes didn’t hear any more movement. The complainant from the warrant (Monica Thompson) had made arrangements earlier in the week to come to the sheriff’s office to make a statement against Calvert. Fearing that Thompson may be in danger, the officers announced that they were going to make entry if someone did not open the door. At this point, Donelson deployed his asp baton and broke a small window to make entry into the residence. Once the officers started to make entry, Thompson ran to the officers and advised Calvert would not let her answer the door. The officers located Calvert and placed him in custody without incident. Zirk obtained a hand written statement from Thompson were she advised that she had a physical altercation with the defendant on Monday evening. She said she wanted to come give a statement at the sheriff’s office but the defendant allegedly would not let her leave the residence or make any phone calls. She states that he would allegedly often keep her at the house against her will. Thompson advised that she had told the defendant that he would get in trouble for holding her against her will and he allegedly said prove it. She said she attempted to answer the door when officers arrived but he told her not to. She also said that at some point he moved her to the bedroom and she allegedly told him just open the door because he was making it worse. She said Calvert allegedly said let them break the door down. Thompson advised that she attempted to answer the door when he put his hand on her leg and would not let her do so. She said when the officers attempted to make entry she ran to the door. Calvert is under a $6.500 cash only bond and a court hearing is scheduled for April 14 at 11 a.m. before Magistrate Riley H. Barb.
William (Bill) Edward Calder, Parsons, has been charged with two felony counts Possession of wildlife: two felony counts Sale of wildlife; transportation of same: Two misdemeanor counts Conspiracy to violate chapter 20; withholding information and obstructing officers: two misdemeanor counts forgery and two counts uttering. According to the criminal complaint, on Oct. 16, 2015 the defendant did purchase two deer from a confidential informant and an undercover officer for $20. Then the defendant allegedly stated it was illegal for him to take unchecked deer. He then handed the undercover officer an orange DNR flyer that shows how to check in a deer. The defendant then went through the trash allegedly looking for information that could be used on the two deer. He allegedly stated that they had to be tagged just in case the local game warden would check him. The defendant allegedly had the CI and undercover officer drag the deer into a building, not the butcher shop. As they drug the deer into the building, the defendant noticed the deer had been shot with a rifle and he asked if that was a bullet hole and the undercover officer just looked at the defendant and the defendant allegedly stated that it was alright that he would take care of it. After the deer were hung up, the undercover officer took a picture of both deer with the fraudulent tags on the deer and a picture of money given to the undercover officer and the orange flyer. He was taken into custody by Cpl. T.L. Fluharty of the Department of Natural Resources. He is under a $21,800 cash bond and is in the Tygart Valley Regional Jail.

- State of West Virginia verses Everett E. Mulkeen, Independence: This case received judgment of Dismissed by Mag-State-No fee for one count Trespass in structure or conveyance with a violation date of Jan 23 and 24. The case was dismissed without prejudice. The case was ordered and adjudged on Feb. 9 by Magistrate William M. Miller.
- State of West Virginia verses Mariah K. Tasker, Eglon: This case received judgment of Guilty-Plea Agreement for one count Trespass after notice; exposing another’s property violation date of April 19, 2015. He was assessed fines of $100; cost and fees of $165.25 and must pay restitution of $82.50. The case was ordered and adjudged on Feb. 24 by Magistrate William M. Miller.
- State of West Virginia verses Michael J. Kulak, Eglon: This case received judgment of Guilty-Plea Agreement for one count Trespass after notice; exposing another’s property violation date of April 19, 2015. He was assessed fines of $100; cost and fees of $165.25 and must pay restitution of $82.50. The case was ordered and adjudged on Feb. 24 by Magistrate William M. Miller.

- State of West Virginia verses Caitlyn Rose Hebb: judgment of Probable Cause found for one count child abuse resulting in injury that occurred on Dec. 10, 2015. The case was heard on Feb 16 by Magistrate Riley H. Barb.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- St. George Medical Clinic verses Mitchell: The court granted judgment Dismissed against Mitchaela Mitchell. Parties have settled. The case was ordered and adjudged on Feb. 26 by Magistrate William M. Miller.
- State of West Virginia verses Ryan Lee White, Oakland, Md: He received judgment of Guilty-Plea Agreement for one count unlawful use of a motorized vehicle on National Forest that occurred on April 19, 2015. He was assessed fines of $20 and cost and fees of $165.25. This case was ordered and adjudged on Feb. 24 by Magistrate William M. Miller. He also received judgment of Guilty Plea-Agreement for one count Trespassing after notice; exposing another’s property on April 19. He was assessed fines of $100; cost and fees of $165.25 and restitution of $82.50. The following charges were Dismissed by Mag-State-No fee for one count Vandalism (caves); conspiracy; construction of section and unlawful injury to or destruction of property. All the charges occurred on April 19, 2015. This case was ordered and adjudged on Feb. 24 by Magistrate William M. Miller.
- State of West Virginia verses Joseph Kevin Mullooly, Weston: He received judgment of Guilty Verdict for one count vehicles must stop at through highways; erection of signs with a violation date of Jan. 18.
