The following criminal complaint has been filed in the Tucker County Magistrate Court:
William Joseph Tolin, Elkins, has been charged with Destruction of Property. According to the complaint, on Friday, April 1 at approximately 3 a.m. Cpl. J.E. Kopec received a call from the victim, David John Scott, Jr. about his window being broken out of his garage located at 224 Kent Ave. in Davis.
Kopec arrived on scene and took several digital photos of the scene which depict the garage window being broken out and a wallet inb front of the garage.
Kopec obtained a one page hand written statement from the victim summarizing that on Thursday, March 31 at approximately 8 p.m., he was in his garage and the window was not damaged and the following day, April 1, he noticed that it was broken out. Scott stated that he noticed a wallet in the driveway and he turned it over to Kopec. Nothing was missing from the garage and Scott believed the replacement value of the window is approximately $150.
Kopec received a wallet belonging to the suspect, William Joesph Tolin, with his license and other miscellaneous contents in it. This wallet was logged into evidence at the Parsons State Police Detachment. Kopec tracked down Tolin by information in his wallet and set up an interview with him in reference to his investigation.
On Tuesday, April 5, at approximately 7:04 p.m. Kopec met with the defendant at the Parsons State Police Detachment. Tolin filled out and signed DPS form 79 Interview and Miranda Rights form. A one page hand written statement from Tolin where he confesses to allegedly breaking out the victim’s window. He states that he did not intend to steal anything in the building nor did he ever gain access to the building. Tolin stated that he was drunk and thought he was being chased by bar patrons that were following him from the establishment he had formerly departed from.
Tolin advised that he allegedly used his shoulder to break out the window and that he did lose his wallet at the scene which contained his driver’s license. He posted a $500 PR bond.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
State of West Virginia verses Jarrod Dale Whitehair, Davis: He received judgment of guilty verdict for one count traffic violations in construction zone which occurred on May 11. He was assessed fines of $50 and court cost of $165.25. This case was heard on June 16 by Magistrate William M. Miller. He also received judgment of dismissed by Mag-State-No fee for one count speed limitations on that same date.
State of West Virginia verses Stephen James Plum: He received judgment of guilty plea-agreement for one count driving under the influence with alcohol concentration in blood less than .15. This occurred on April 25. He was assessed fines of $100, court cost of $240.25 and credit for one day served in jail. He also received judgment of dismissed-Plea agreement for one count driving while license suspended or revoked. This case was heard on June 13 by Magistrate William M. Miller.
State of West Virginia verses Eric Lester Mullenax, Parsons: He received judgment of no contest plea for one count, making, issuing worthless checks. He was assessed fines of $190.25 and restitution of $38.18. This occurred on Jan. 7 and case was heard on June 7 by Magistrate Riley H. Barb.

State of West Virginia verses Michael Kevin Harris, Belington: He received judgment of dismiss by Mag-State-No fee for one count driving while license revoked for DUI and speed limitations which occurred on April 30. Motion to dismiss by State – Granted. Dependant is being extradited to Virginia. This case was heard on June 14 by Magistrate Riley H. Barb.
State of West Virginia verses Brian Keith Calvert, Masontown: He received judgment of dismissed by Mag-State-No fee for one count domestic battery which occurred on Feb. 22. Motion by State to dismiss per plea agreement – Granted. This case was heard on June 16 by Magistrate Riley H. Barb.
Shanna Pennington verses Robin Darlington: The court found in favor of Pennington and Darlington must pay $99.41 plus $75 court cost.
St. George Medical Clinic verses Damion Monroe: Court finds in favor of St. George Medical Clinic in the amount of $164 plus $75 court cost.
