The following criminal complaints have been filed in the Tucker County Magistrate office:
- Jesse William Florentine of Eglon was charged with Obstructing an officer on Feb. 17. According to the criminal complaint, on Monday, Feb. 17, Cpl. D. W. Burge was conducting a traffic stop in Davis when he was approached by the defendant, whom was recording the traffic stop. The defendant continuously interrupted the officer while attempting to enforce the laws of this state and dealing with an escalating situation. The defendant was told by Burge several times to back away from the traffic stop, and stop interrupting the officers. The defendant allegedly continued to move around the stopped vehicle yelling at the officer and escalating the temperament of the driver of the stopped vehicle. Burge gave a lawful order to the defendant to stop obstructing and interfering in the situation or he would be arrested. Florentine allegedly continued obstructing and was arrested.
- Aaron Spencer Turner of Davis was charged with Obstructing an officer and Failure to change driver’s license. According to the criminal complaint, on Monday Sept. 16, 2013 Cpl. D. W. Burge initiated a traffic stop on the defendant for going 58 in a 45 mile an hour work zone. Burge approached the vehicle and asked for driver’s license, insurance card and registration card. Allegedly at this time the defendant gave him a driver’s license registered in Georgia. When asked where he lived the defendant stated that he had moved to Davis over two years ago. He also advised the officer that he did not have his insurance or registration with him. At this time the defendant allegedly advised that he was a citizen of the people and he had done nothing wrong and should not have been stopped. The officer advised the defendant that he was in violation of West Virginia laws by not changing his driver’s license and Turner allegedly stated that he did not have to change his license. He advised that our laws do not apply to him because he does not work for the state or federal government and does not receive any benefits from either. After a considerable amount of time, the officer told the defendant that no matter what his beliefs, it was required by law that he contact the magistrate within five days for the charge of speeding. At this time the defendant took the traffic citation and drove away.
- Aaron Spencer Turner of Davis was charged with Obstructing an officer. According to the criminal complaint, on Monday, Feb. 17, Cpl. D.W. Burge observed a vehicle operating in Davis with no visible MVI sticker and no visible registration plate on the vehicle. Initiating a traffic stop, Burge approached the vehicle and asked Turner for the vehicle registration, insurance card and driver’s license. The defendant allegedly stated that he did not have to give the officer the information and he did not have the information. The defendant would not answer questions or provide ownership of the vehicle. Burge asked the defendant to exit the vehicle several times and the defendant locked the doors and refused to exit the vehicle. Burge advised the defendant that he was under arrest for outstanding warrants and eventually the defendant opened the door and was taken into custody.
- Richard Raymond Linger of Norton was charged with two counts of Possession of a controlled substance. According to the criminal complaint, Dep. C. A. Teter was dispatched by a call from Tucker County 911 to Jim Propst Grocery Store for two individuals possibly being under the influence. When individual was detained a knife was found along with what the defendant allegedly described as Methadone. Also found was Morphine and what is suspected as Marijuana.
- Denny Ray Wiseman of Elkins was charged with Possession of a controlled substance. According to the criminal complaint, Dep. C. A. Teter was dispatched by a call from Tucker County 911 to Jim Propst Grocery Store for two individuals possibly being under the influence. When the individual was detained there were allegedly Morphine pills found in his pocket.
- Patrick Wayne Fladung of Hambleton was charged with a felony charge of Possession with intent to deliver and a misdemeanor charge of Concealed Carry Weapon. According to the criminal complaint, on Saturday, Feb. 22 about 10:15 p.m., a silver Subaru was stopped on US219 by Cpl. M.S. Wetzel and Dep. C.R. Donelson. The occupants were later identified as Chris Bonner, driver, and Patrick Fladung, passenger. When Wetzel approached the vehicle, he allegedly saw Fladung conceal something inside his jacket. When questioned if he had anything illegal on his person, Fladung allegedly stated that he had a little bit of weed in his pocket. At this time, the defendant reached into his pocket and allegedly pulled out a large mason jar full of marijuana buds. These buds were field tested and indicated for the presence of THC. Fladung then allegedly reached inside his pocket and gave the officer a set of digital scales. At this time Cpl. D.W. Burge, of the Parsons Detachment of the West Virginia State Police, interviewed Bonner. Allegedly within his statement, Bonner indicated that when the blue lights came on, Fladung immediately stated that he had some dope on him. At this time, Flagund pulled out a jar of marijuana from his coat and allegedly tried to hide it. When questioned at the WVSP Parsons Detachment, Fladung allegedly stated that he had purchased the marijuana in Elkins for $500 in cash. It should be noted that Fladung allegedly had a set of aluminum knuckles concealed with the marijuana inside his pocket. Cpl. Burge obtained a weight of the marijuana which showed 55.5 grams or slightly above two ounces.
