The following criminal complaint has been filed in the Tucker County Magistrate Court:
- Marian Stinson, Davis, was charged with DUI. According to the complaint on Saturday, June 16 at approximately 7:16 p.m. Cpl. D.W. Burge of the West Virginia State Police received radio communication from Tucker County 911 of a single vehicle accident with rollover on Back Hollow Rd. He arrived on scene and observed a female, later identified as the defendant, kneeling on the ground near the driver side door. He approached her and asked what happened. She advised she did not know for sure and the officer observed the odor of alcohol on her breath. He asked if she had consumed any alcoholic beverages prior to the accident, and she allegedly advised she had consumed a little alcohol hours ago. He asked if she was driving at the time of the accident and if she was by herself. She said she was driving down the hill and she had two dogs with her. Burge looked inside the vehicle and observed an open bottle of wine, an empty wine bottle, several mixed unopened beer containers and a plastic cup with ice and the odor of an alcoholic beverage in the driver’s seat. He initiated a preliminary breath test and she failed. She was then transported by Tucker EMS to Garrett Memorial Hospital due to injuries.
