The following citations have been recorded in the Tucker County Magistrate office:
- Benjamin D. Massie, II, Peterstown, was cited for speeding (69-65) by TFC J.J. Schmidle. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Danielle C. Carr, Hambleton, was cited for sale of alcohol to underage by Cpl. J.E. Kopec. She pled no contest and was assessed fines of $25 and court cost of $165.25.
- Burke Alan Adkins, Reston, Va. was cited for speeding (69-65) by TFC L.J. Schmidle. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Joseph H. Thorpe, West Union, was cited for public intoxication by Deputy B.T. Zirk. He pled no contest and was assessed fines of $5 and court cost of $165.25.
- Candace R. Nelson, Charleston, was cited for failure to maintain control by Deputy B.T. Zirk. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
The following criminal complaint has been filed in the Tucker County Magistrate Court:
- Thomas Bruce Summerfield, Jr., Davis, was charged with one count DUI. According to the complaint, on Tuesday, Aug. 14 at approximately 9 a.m. Deputy C.A. Teter of the Tucker County Sheriff’s Department received a complaint of a possible signal 9 driver, Thomas Summerfield who was driving a red Pontiac car, at Davis Thomas Elementary Middle School from the Tucker County 911 Communication Center. It should be noted that the defendant’s child is not currently enrolled in Davis Thomas EMS but is enrolled at Tucker Valley EMS. Teter located said vehicle in Parsons and observed the defendant driving. He is known to not have a valid driver’s license. He was also not wearing a seatbelt. Teter initiated a traffic stop after observing the vehicle swerving in and out of lane of traffic. When the driver was confronted he began to swear at the officer and was asked to exit the vehicle. At this time the defendant was allegedly observed to be unsteady and slurring his speech. He was asked to perform field sobriety tests which he failed. He was placed under arrest and transported to the Parsons Police Department for processing. He was transported to Davis Medical Center for a blood draw, where he submitted, and then transported to Tygart Valley Regional Jail. It should be noted that the defendant was from one extreme of being content to the other of crying/emotional and talking about not being worth anything. It should be further noted that the defendant pulled into the parting lot of DTEMS and dropped off his child while in this condition. He allegedly stated to Teter that he had used marijuana and used methamphetamine within the last few days. He posted a $1,500 PR bond and a court hearing is scheduled for Sept. 18 at 2 p.m. before Magistrate William m. Miller.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses James Payden Michael: he received judgment of guilty plea for one count unlawful injury to or destruction of property which occurred on May 28. He was assessed fines of $10 and court cost of $165.25. This case was heard on Aug. 9 by Magistrate William M. Miller.
- State of West Virginia verses Jeremy Edward Rexroad: He received judgment of guilty plea for one count shoplifting – concealing merchandise which occurred on June 19. He was assessed fines of $10 and court cost of $165.25. This case was heard on Aug. 9 by Magistrate William M. Miller.
