The following criminal complaint has been filed in the Tucker County Magistrate Court:
- Joshua Michael Swisher, Morgantown, was charged with one felony count of Grand and petit larceny; two felony counts Conspiracy; and one felony count Altering or changing a manufacturer’s serial number, motor or engine number. According to the complaint on Friday, April 15, the defendant conspired with Mario Orellana, owner and operator of ITT LLC by cellular phone, to steal a 2000 Rittenour trailer belonging to Cynthia Harman from the parking lot of Kidwell Autoparts. This parking lot is located in Thomas. The subjects further conspired to remove the Vehicle Identification Plate and replace it with a plate registered to Orellana. Swisher allegedly took the stolen trailer to the truck yard of Orellana located in Preston County. At that location Sgt Simmons located and recovered the trailer while it was in tow by Swisher. The officer further discovered upon analysis of cell phone records that Swisher was in Tucker County in the area in which the trailer was stolen. It also revealed direct communication between Swisher and Orellana during the theft. This trailer was subsequently identified by a unique and specific secondary identification number and returned to the owner. The registration plate registered to this unique stolen trailer was allegedly recovered by the Grant County Sheriff’s Department from a vehicle in which Swisher was occupying during the commission of a crime in their county. Value of said trailer is listed at approximately $10,000. Swisher posted a $20,000 property/surety bond and a preliminary hearing is scheduled for May 23 at 10 a.m. before Magistrate William M. Miller.
