The following criminal complaints have been filed in the Tucker County Magistrate Court:
William George Ball, Jr. was charged with two counts of Retaliation against public officers and employees. According to the complaint, on Tuesday, Aug. 3 the defendant and Roberta Helmick (Outreach Coordinator/WAC-CAV) were leaving family court after a DVPO status hearing. This hearing was filed against Mr. Ball’s daughter’s biological mother, Kala Carver, on the daughter’s behalf. Roger Brown, a Child Protective Service worker, had testified in the hearing via telephone and informed the Judge that no accusations were substantiated and that he was closing the case with the daughter’s biological mother. Brown also informed Ball at that time that he would be filing charges against Ball in Randolph/Tucker Counties for mental and emotional abuse against his daughter. The Family Court Judge dismissed the Domestic Violence Protective Order and Ball and Helmick exited the courtroom. They walked down the hall and entered the stairwell to exit the building, at which point Ball looked at Helmick and allegedly said, “I am going to get a gun and I am going to shoot Brown.” They exited the building and Ball returned to his vehicle and left the parking lot. Helmick went to the Tucker County sheriff’s office to speak with an officer about the threat that Ball made regarding Brown. After leaving the courthouse Ball traveled to the babysitter’s residence to exchange custody of his daughter with her mother. During this exchange Ball allegedly made more threats toward Brown. Carver claimed that Ball allegedly had put his hand on his pistol and allegedly said, “I have something for Brown when I see him” and tapped the pistol with his hand. The pistol had a snake like grip. Sgt. C.A. Teter of the Tucker County Sheriff’s office also received a statement from Kurtis Barb stated that Ball had made threats toward Brown allegedly stating that he had something for Brown when he sees him. Barb also described the pistol with a snake, scale looking grip. Teter was dispatched to BFS to speak with a caller about this incident but when en route he was flagged down by Ball and his girlfriend, Rebecca Surguy who wanted to speak to him about the investigation of the alleged sexual assault of his daughter. While speaking to Ball, Teter observed a pistol with a snake skin print on the hip of Ball in a black holster. Ball took the pistol off and laid it in the passenger seat of the vehicle he was traveling in. Teter took the pistol into custody for evidence and he took a written statement from Ball and Rebecca Surguy. He posted a $4,000 PR bond and a preliminary hearing is scheduled for Sept. 20 at 10:30 a.m. before Magistrate William M. Miller.
Trevor Allen Roy, Davis, was charged with two counts Sexual Assault 2nd Degree. He complaint states that on Monday, Aug. 19 Cpl. B.T. Zirk of the Tucker County Sheriff’s office (TCSO) obtained a written statement from Cheyenne Mikela Davis regarding a sexual assault hat had occurred. She stated the day before the Domestic Battery incident (Saturday, June 2) Roy was accusing Davis of cheating on him. She stated he allegedly said he wanted to see if she was cheating on him or if she was hiding anything and she told him “No.” She stated this all happened while they were lying in bed. She stated he allegedly held her down by placing his right forearm across her chest and she told him “No” and “To Stop.” She said that a couple weeks prior to this incident she, along with her kids, was in the living room with Roy and he began to accuse her of hiding a phone and he wanted to see it. She said she was telling him he needed to stop because she did not want the kids to hear this. She stated after he realized she did not have a phone he continued to yell and search through the house for a phone. She stated through the entire incident she told him to “Stop and leave her alone” multiple times. Roy is under a $20,000 cash bond that was not posted.
