The following criminal case has been filed in the Tucker County Magistrate Court:

Nicolle Elizabeth Hebb, Thomas, was charged with one count of Driving under the influence.  According to the complaint, on Wednesday, Dec. 25 at approximately 4:41 a.m. Cpl. B.T. Zirk of the Tucker County Sheriff’s office was dispatched to 17 South Euclid Ave in Thomas for a single vehicle accident.  He arrived on scene to find a vehicle crashed into a tree in the yard of above address.  It appeared the vehicle was traveling south on WV32 when it exited the roadway on the right hand side, traveled into the yard and crashed into the tree.  While walking to the crashed vehicle, the defendant came up to Zirk and began to talk.  She stated she came around the turn and must have hit some gravel in the road.  Zirk observed what appeared to be the odor of an alcoholic beverage on her breath.  He asked where she was coming from and she stated she was leaving work at the bar and was going to BFS to get cigarettes.  Zirk asked if she had anything to drink tonight and she allegedly stated she had one drink.  She was asked to perform a series of field sobriety tests and she failed all of them.  He asked her to submit a preliminary breath test (PBT) to which she agreed, understood and performed, failing with a reading of .140.  Prior to performing the PBT she stated she actually had two drinks and her last drink was at approximately 11 p.m.  She also stated that she was ready to go to jail.  He then placed her under arrest for DUI and transported her to the Parsons City Police Department for processing.  Zirk read and explained the West Virginia Implied Consent Statement to which she stated she understood and signed.  Once the time came for her to perform the test she allegedly stated she did not want to do it.  She was provided 15 minutes to which she again refused the test.  She was then finger printed and while doing so she became upset and began to cry and allegedly stated she screwed up and she has a problem.  Zirk asked her if her problem is with alcohol or drugs and she stated both.  She was then transported to the Tygart Valley Regional Jail.  A $500 PR bond was posted.
