The following citations have been recorded in the Tucker County Magistrate office:
Cody RT. Yingst, Hurricane, was cited for possession of marijuana less than 15 grams by Deputy C.R. Donelson. The charge was dismissed.
Jessica D. White, Elkins, was cited for speeding (55-45) by Cpl. D.W. Burge. She pled guilty and was assessed fines of $4.75 and court cost of $165.25.
Bryanna J. Claus, Buckhannon, was cited for expired MVI and no insurance by Cpl. D.W. Burge. Both charges were dismissed with proof shown.
Summer D. Vance, Parsons, was cited for contributing to the delinquency of a minor by Cpl. D.W. Burge. She pled no contest and was assessed fines of $25 and court cost of $165.25.
Katherine A. Lillie, Horseshoe Run, was cited for sale of alcohol to underage by Cpl. J.E. Kopec. She pled no contest and was assessed fines of $25 and court cost of $165.25.
Michael E. Weaver, Arthurdale, was cited for speeding (65-55) by TFC J.J. Schmidle. He pled no contest and was assessed fines of $20 and court cost of $165.25.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
Marshall D. Poling Jr. Parsons, was charged with Domestic battery; Resisting arrest and one felony count of Strangulation. According to the complaint, Parsons Police Chief W.D. Rowe received a radio call from 911 in reference to a domestic. Rowe, Tucker County Sheriff B. K. Wilfong and Special Deputy T.L. Fluharty responded to the scene. Upon arrival, the defendant and his wife were in a verbal argument. Wilfong asked the female what happened and she stated that the defendant allegedly hit her several times in the head and face area and then choked her. He asked the defendant to get his shirt on and the defendant allegedly became very abusive. The defendant allegedly became very aggressive with Wilfong. While attempting to detain the defendant, he became very combative. He obstructed/resisted arrest and all the officers handcuffed him. The female had several marks on her neck and face area. The defendant is under a $1,000 cash only bond for the misdemeanors and a $5,000 cash only bond for the felony charge. No bond was entered at time of this report.
Hoy Michael Eye, Hendricks, was charged with Harassment. The complaint states that on Nov. 19, 2016, the defendant allegedly traveled to the residence of Don Eye where Okey Brian Eye was located. The defendant blocked the roadway and allegedly threatened Okey Eye with bodily harm. On Dec. 28, 2016, the defendant allegedly traveled to the residence of Okey Eye, along with two unidentified males. The defendant allegedly threatened him, advising he was going to whip him. Okey Eye picked up a piece of metal to defend himself, and the defendant allegedly told him that if he got out of the vehicle that Okey Eye would not walk away. The defendant posted a PR bond of $500.
Cassandra Dawn Poling, Parsons, has been charged with one felony count of Cultivation of Marijuana. According to the complaint, on Friday, Jan. 20, Cpl. D.W. Burge, of the Parsons Detachment of the West Virginia State Police, was contacted by Ronald Dale. Poling, who advised that his daughter Cassandra Dawn Poling had allegedly stolen items from him. Upon arrival, Poling advised the officer that the defendant had allegedly been cultivating marijuana in a grow room in his attic. Burge and Poling went to the attic and he observed four grow rooms purple in color, and a bag containing a green leafy substance believed to be marijuana. Burge obtained a hand written statement from Poling advising that the defendant had grown marijuana in his residence, then removed the plants and part of the grow lab components. A search warrant was obtained and four purple grow rooms, one black in color exhaust fan, one plastic bag containing a green leafy substance believed to be marijuana, one nutrients grow chart, two white in color grow lamps and a pan containing a green leafy substance believed to be marijuana were seized. A cash bond of $15,000 was not entered and a preliminary hearing is scheduled for Feb. 7 at 3 p.m. before Magistrate William M. Miller.
Cassandra Dawn Poling, Parsons, was charged with False information to Trooper. The complaint states that on Saturday, Jan 21, at approximately 9 p.m. Cpl. D.W. Burge was with Probation and Parole officer Alex Trenz at the current residence of the defendant. He asked the defendant where she was and if her boyfriend, Joshua Alan Geiger AKA Baron, was with her today. She allegedly advised that she was with a friend but she had not seen Geiger, and he was not with her. After questions from Trenz, she admitted she had been in Maryland with Geiger today also, he had her cell phone. A cash bond of $1,000 was not posted.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
State of West Virginia verses Cody T. Yingst, Hurricane, received judgment of Dismissed by Mag-State-No Fee for one count malicious or unlawful assault causing bodily injury with intent to maim, disfigure, disable or kill which occurred on Jan. 11, Pursuant to Plea Agreement. This case was heard on Jan. 18 by Magistrate Riley H. Barb.
State of West Virginia verses Jonathan E. Keplinger, Lahmansville, received judgment of no contest per plea agreement for one count driving vehicle while in an impaired state which occurred on Nov. 20, 2016. He was assessed fines of $100 and court cost of $240.25 with credit for three days time served. He received judgment of no contest per plea agreement for one count obstructing an officer which occurred on Nov. 10, 2016. He was assessed cost and fees of $165.25 and 57 days in jail. He also received judgment of dismissed plea agreement of one count obstructing an officer which occurred on Nov. 10, 2016. These cases were heard on Jan 12 by Magistrate William M. Miller.
