The following criminal complaints have been filed in the Tucker County Magistrate Court:
Bonita Nesbitt Duncan, Columbia, SC, was charged with DUI. According to the criminal complaint, on Sunday, Aug. 13 at approximately 9:35 p.m. Cpl. D.W. Burge, of the Parsons Detachment of the West Virginia State Police, was traveling south on US219 when he observed a gray Honda Civic approach the rear of the issued State Police Cruiser at a high rate of speed. He observed the Civic following at approximately ½ car length of the cruiser for about one mile. He pulled off the roadway and observed said vehicle accelerate rapidly and cross the center line of the roadway. He followed said vehicle and observed it to run off the roadway to the right three times and cross the center lane two times. He initiated a traffic stop and found the driver to be the defendant. She had red, blood shot, glassy eyes and he allegedly smelled alcohol on the breath. Burge asked her to exit the vehicle and asked if she had been drinking alcoholic beverages. She advised that she had consumer alcohol at her sister’s residence in Virginia earlier in the day. Burge conducted a Preliminary Breath Test, and field sobriety tests, all of which the defendant failed. She was arrested for DUI. She was transported to the Parsons City Police Office for a secondary breath test utilizing Intoximeter EC/IR II. She signed WVSP form 47A Implied Consent and 15 minutes was observed. Burge explained the secondary breath test and Duncan failed to provide adequate breath samples three consecutive times constituting a refusal. She was read Miranda Rights and she advised she understood her rights and signed the form. Burge was advised by the defendant that she had allegedly consumed three shots of whiskey while taking her prescription medications in Virginia prior to driving to Tucker County. She posted a $500 PR bond and a court hearing is scheduled for Oct. 4 at 10 a.m. before Magistrate William M. Miller.
Mindy Durham, Parsons, was charged with failure to pay animal registration and cruelty to animals. The complaint states that on July 29 the defendant had five dogs and two cats in her residence at 163 Overlook Drive. The defendant was not living at that location. The animals had allegedly been in the residence for weeks. Animals had very little water and no food. The residence had animal feces all over it and not livable. A check with county reveals that no taxes had been paid on any of the animals. A court hearing is set for Oct. 6 at 10:30 a.m. before Magistrate William M. Miller.

Knotts verses Bishoff: The court found in favor of Roberta A. Knotts against Jessica Lynn Bishoff in the amount of $623.25 plus $40 court cost. This case was heard on Aug 16 by Magistrate Riley H. Barb.
State of West Virginia verses Frank Roman Ortolani, Clarksville, Tenn. received a guilty-plea agreement for one count unsafe and improperly equipped vehicles which occurred on June 1. He was fined $50 and cost and fees of $165.25. This case was heard on Aug. 18 by Magistrate Riley H. Barb.
State of West Virginia verses Teresa Colleen Moore, Belington, received a no contest plea for one count driving to fast for roadway conditions. She was assessed fines of $4.75 and court cost of $165.25. This case was heard by Magistrate William M. Miller.
Parsons Shop-n-Save verses Jamie Lynn Huffman, Parsons, received judgment of a guilty-plea agreement for one count making, issuing worthless checks on June 26. She was assessed cost and fees of $190.25 and restitution of $180.50. This case was heard on Aug. 16 by Magistrate Riley H. Barb.
