The following citations have been recorded in the Tucker County Magistrate office:
Anthony W. Costello, Toms Brook, Va. was cited for speeding (55-45) by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
Rocky E. Nestor, Parsons, was cited for no seatbelt by Cpl. J.E. Kopec. He pled guilty and was assessed fines of $25.
Sam L. Workman, Elkins, was cited for no insurance and expired MVI by Cpl. D.W. Burge. The first charge was dismissed with proof shown and he pled no contest to the second charge and was assessed fines of $4.75 and court cost of $165.25.
Denver J. Cussins, Hambleton, was cited for no seatbelt by Sgt. C.D. Siler. He pled no contest and was assessed fines of $25.
Wellington A. Arguello, Richmond, Va. was cited for speeding (60-45) by Cpl. J.E. Kopec. He was assessed fines of $4.75 and court cost of $165.25.
John J. Eye, Hendricks, was cited for failure to use due care by TFC J.J. Schmidle. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
Merle H. Payne Jr, Webster Springs, was cited for speeding (69-55) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
Trevor J. Reichman, Terlingua, Texas, was cited for the sell of alcohol to underage minor by Cpl. J.E. Kopec. He pled no contest and was assessed fines of $25 and court cost of $165.25.
Matthew S. McCarthy, Blakeslee, Pa. was cited for speeding and driving while suspended by Cpl. M.S. Wetzel. He pled no contest and was assessed fines of $104.20 and court cost of $331.60.
Luisa F. Martinez-Neira, Lorton, Va. was cited for speeding by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
Roberta J. Alderman, Parsons, was cited for no seatbelt by TFC J.J. Schmidle. She pled no contest and was assessed fines of $25.
Jasur Muhtorov, Elizabeth, NJ, was cited for failure to obey traffic device by Deputy C.A. Teter. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
Ckistian R. Wicha, Falls Church, Va. was cited for speeding (59-45) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
Timothy E. Nicmenski, Parsons, was cited for no seatbelt and no operators by Sgt. C.D. Siler. He pled no contest and was assessed fines of $25. The second charge was dismissed with proof shown.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
Jamie Lynn Huffman, was charged with obstructing/resisting an officer. The complaint states that on Oct. 31 Sgt. C.D. Siler, of the Parsons Detachment of the West Virginia State Police and Tucker County Chief Deputy, E.C. Surguy, were at the residence of Crystal Hinkle to arrest Jamie L. Huffman on a Capias. Sgt. Siler was already informed that Huffman was upstairs in the bedroom with her boyfriend, Christopher S. Earnest. Upon going upstairs the officers found Earnest sitting on the bed facing the closet. When Siler asked Earnest where Huffman was, he allegedly stated that he did not know where she went. Surguy and Siler continued to search the upstairs and found Huffman in the corner of the closet. Both Huffman and Earnest were arrested at this time. Huffman is under a $2,000 cash bond and a hearing is scheduled for Jan. 5, 2017 at 11:30 a.m. before Magistrate Riley H. Barb.
Christopher Scott Earnest, Parsons, was charged with false information to Trooper. The criminal complaint states that on Oct. 31 Sgt. C.D. Earnest is under a $2,000 cash bond that was not entered.
Bonita Nesbitt Duncan, Hendricks, was charged with driving suspended; false information to Trooper and speeding in construction zone. According to the complaint, on Sept. 12 Sgt. C.D. Siler, of the Parsons Detachment of the West Virginia State Police, was conducting routine road patrol on US93 in the area in which road construction is taking place. This section of the highway is designated as a 45 MPH construction zone 24 hours a day. While conducting moving radar, Siler observed a vehicle traveling west bound at a high rate of speed. He estimated the vehicle’s speed to be 74 MPH. Siler stopped said vehicle and identified the defendant by her South Carolina Operators. The vehicle was bearing West Virginia temporary registration. The defendant allegedly lied to Siler about the length of time she has lived in WV and she has several suspensions in Virginia on her Virginia driver’s license. The defendant allegedly stated that she had only been the WV for over a month, when in fact she has lived in Hendricks for at least one year. The defendant has four active suspensions out of Virginia for unpaid citations. She posted a $1,400 property/surety bond. A hearing is scheduled for Jan. 5, 2017 before Magistrate Riley H. Barb.
Staci Diane Smith, Hepzibah, was charged with delivery of a controlled substance and conspiracy. The complaint states that on Friday, Nov. 13, 2015 Deputy C.R. Donelson and Deputy C.A. Teter, of the Tucker County Sheriff’s Department, met with a confidential informant in reference to a controlled substance. The CI stated he could buy ten clonazapam pills, a schedule IV controlled substance, off of the defendant, Staci Diane Smith, for $3 a pill totaling $30. He stated that he contacted Jesse Suesli via text message and inquired if he had any pills and Suesli allegedly said he had ten pills. The CI traveled to the residence of Suesli and Smith and met with said subjects. The CI stated he allegedly handed Smith $30 and she handed him ten pills. The CI states that Suesli was on the couch watching TV when the transaction took place. Smith is under a $25,000 bond.
Staci Diane Smith, Hepzibah, was charged with delivery of a controlled substance and possession with intent to deliver. The complaint states that on Monday, April 11, 2016 Deputy C.R. Donelson of the Tucker County Sheriff’s office along with Cpl. D.W. Burge, of the Parsons Detachment of the West Virginia State Police, met with a confidential informant in reference to a controlled purchase. The CI stated he could buy ten clonazepam pills, a schedule IV controlled substance, off of the defendant for $3 a pill totaling $30. The CI traveled to the Overlook Trailer Court and allegedly met with the defendant and completed the purchase. Smith is under a $25,000 bond.

State of West Virginia verses Joshua D. Poling: He received judgment of guilty plea for two counts making, issuing worthless checks which occurred on Sept. 29. He was assessed fines of $380.50 and must pay restitution of $26.50. This case was heard on Oct 27 by Magistrate Riley H. Barb.
