The following citations have been recorded in the Tucker County Magistrate office:
- Lindsey D. Shiflett, Parsons, was cited for no seatbelt by Sgt. C.D. Siler. She pled guilty and was assessed fines of $25.
- Lindsey D. Shiflett, Thomas, was cited for expired operators and no insurance by Deputy C.A. Teter. She pled no contest to both charges and was assessed fines of $2.4.75 and court cost of $330.50.
- Emily B. Sutton, Elkins, was cited for speeding (70-45) by Sgt. C.D. Siler. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Timothy M. Hyle, Abingdon, Md. was cited for failure to maintain control by Deputy C.R. Donelson. He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
- Carl D. Ratliff, Jr. Oakland, Md. was cited for failure to maintain by Chief Deputy E.C. Surguy. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Angela D. Yucheck, Parsons, was cited for driving suspended first offense and unsigned registration card. She pled no contest to both charges and was assessed fines of $104.75 and court cost of $330.50.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Ashley Lipscomb, Davis, was charged with Truancy. The complaint states that the defendant did allegedly fail to cause a minor to regularly attend Davis Thomas Elementary School without just cause. The student has accumulated 15 full unexcused days. She posted a $50 PR bond and a court hearing is scheduled for Nov. 30 before Magistrate William M. Miller.
- William Earl Shaw, III, Parsons, was charged with assault. According to the complaint, on Nov, 2 at 12 a.m. David E. Gidley, II, of the Parsons Police Department, was advised of the need to make a public service in regards to an alleged threat that had taken place at Sheetz. Gidley spoke with the complainant, Melissa Edwards. She adived she had been threatened by Billy Shaw in the parking lot of Sheetz prior to her calling 911. The officer advised her of the need to come to city hall and file a complaint if she wished to proceed with the charges. The officer met with the complainant and her daughter, Barbara Pennington. She advised that she was with her daughter while the child was being exchanged between parties when she and the defendant began to argue. During this argument she advised that the defendant allegedly swearing and started towards her in an aggressive manner. This caused her to return to her vehicle and leave the location. She further advised that the defendant’s words and actions made her feel threatened. The officer obtained a statement from Barbara Pennington who witnessed the event and she advised that she felt the defendant’s words and actions towards Edwards were threatening. The defendant posted a $500 PR bond.
- Levi Garrett McCauley, Kerens, was charged with Petit Larceny. The complaint states that on Nov. 13, the defendant was observed removing donuts from the Sheetz store in Parsons without paying for the same. The defendant was allegedly observed on video also of removing these items without paying for same. The value of the stolen items was $6. This incident was investigated by Parsons Police Chief W.D. Rowe.
- Levi Garrett McCauley, Kerens, was charged with a felony for Driving revoked for DUI Third offense. According to the complaint, on Nov. 15 at approximately 6:45 p.m. Cpl. J.E. Kopec was standing in Sheetz parking lot when the accused pulled into the parking lot. Kopec had knowledge of the defendant being revoked for DUI and had received calls on him before for driving revoked ofr DUI. Kopec approached the defendant and asked him if he got his license valid. He informed Kopec that he had paid his fines off but the license was not valid. Kopec ran an license check and found his license was revoked for DUI and that he had a second offense conviction for driving revoked for DUI on May 9. Kopec arrested the defendant and arrangements were made for his vehicle to be picked up. A cash bond of $5,000 and a property surety bond of $5,000 were not posted.
The following cases have been ordered and adjudged in the Tucker Count Magistrate Court:
- State of West Virginia verses Norman R. Cosner, Jr., Elk Garden, received judgment of no contest plea for one count of making, issuing worthless checks which occurred on May 31. He was assessed fines of $1, cost and fees of $190.25 and must make restitution of $108.97. This case was heard on Nov. 13 by Magistrate William M. Miller.
- State of West Virginia verses Kimberly Dillsworth, Davis, received judgment of guilty-plea agreement for one count Domestic Battery which occurred on Sept. 26. She was assessed cost and fees of $165.25, a one year suspended jail sentence and must report to Day Reporting Center for one year. She also received judgment of a motion by the Prosecuting Attorney to dismiss; Granted by the Magistrate and no fees were charged on the case for one count of Domestic Battery which occurred on Sept. 26. This case was heard on Nov. 9 by Magistrate Riley H. Barb.
