The following citations have been recorded in the Tucker County Magistrate office:
- David B. Knott, Oakland, Md. was cited for no proof of insurance by Deputy B.T. Zirk. The charge was dismissed with proof shown.
- Patricia K. Wagner, Hambleton, was cited for expired MVI by Cpl. J.E. Kopec. The charge was dismissed with proof shown.
- Benjamin C. White, Bowden, was cited for speeding (69-55) by Sgt. C.D. Siler. He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
- Robert J. Roy, Jr., Parsons, was cited for no bear stamp by WVDNR. He was assessed fines of $20 and court cost of $165.25.
- Donald A. Barkley, Parsons, was cited for no proof of registration by Sgt. C.D. Siler. The charge was dismissed with proof shown.
The following criminal complaint has been filed in the Tucker County Magistrate Court:
- Tabatha Marie Watson, Dry Fork, was charged with DUI First Offense (Drugs) and Possession of a Controlled Substance. According to the complaint, on Thursday, Dec. 7 at approximately 10:29 a.m. Deputy C.A. Teter, of the Tucker County Sheriff’s Office was dispatched to a subject passed out with vehicle running located on School House Run Road in Hambleton. Upon arrival he observed a gray Jeep Grand Cherokee SUV sitting at the intersection of School House Run Road and Hendricks Hill Road. He got out of his vehicle to check on the driver. He observed a white female identified as the defendant by her operators passed out in the driver’s seat with the vehicle running. He knocked on the window in an attempt to wake the defendant up and check on her. She woke in a groggy condition, and Teter was having difficulty communicating or understanding her. He opened her door for further investigation/check. While speaking to her he noticed her speech was slurred and her eyes were blood shot and glassy. He asked if she was ok and why she was passed out in the roadway. She allegedly stated that she was tired. He asked if she had been drinking or using drugs today. She looked around and allegedly said, “Yes, earlier she had taken her Subutex and taken some Xanax.” The officer asked her to step out of the vehicle to be further checked by EMS personnel. She began to reach around inside the vehicle (glove box, console, etc.). He observed her allegedly grab something from the middle console and attempt to conceal it in her left hand. She also pulled her hand up into her sleeve to try and hide her hand. He noticed that her hand was clinched and asked what was in it she did not respond. He asked her again to open her hand and when she finally did, a clear plastic baggie allegedly containing several green rectangle shaped pills, later identified as Xanax, fell onto the ground. Watson was placed under arrest and placed in the back of Parsons Police Chief Rowe’s vehicle. Teter began a search of the vehicle and allegedly located more Xanax pills, Subutex pills, pill crusher with green residue, two straws with residue in them, a syringe with an unknown clear substance and a clear glass pipe containing suspected methamphetamine along with small torches and an energy bottle containing urine. Watson was transported to the Parsons Police Department for further processing. While on scene at PPD, Teter asked the defendant if she would submit to SFST, which she complied. He explained all the tests, she submitted to tests and failed. Teter read the Implied Consent Form to her she then read it and signed the form. She was then taken to Davis Medical Center for a Blood Draw. She was then taken to Tygart Valley Regional Jail. It should be noted that the defendant allegedly stated that she had snorted 1 ½ Xanax pills that day, taken a Subutex pill and had used methamphetamine within the last few days. She is under a $1,000 cash/surety bond and a court hearing is scheduled for Jan. 25, 2018 at 10 a.m. before Magistrate William M. Miller.
The following cases have been ordered and adjuged in the Tucker County Magistrate Court:
- Donaven K. Kinzer, Fairmont, received judgment for preliminary hearing waived for one count manufacture/deliver/possess with intent to manufacture/deliver (Schedule I or II Narcotics) which occurred on Dec. 8. A $10 fee was assessed and the case was bound over to Tucher County Circuit Court. This case was heard on Dec. 13 by Magistrate Rob Elbon.
- St. George Medical Clinic verses Huffman, The case was dismissed pursuant to Rule 15(b) against Eleanor Huffman. The defendant has filed no answer and plaintiff has not moved for default judgment. This case was heard on Dec. 6 by Magistrate Rob Elbon.
